| 3 | The dwelling hereby approved shall be constructed with external facing materials consisting of: - Kempley Antique Brick - Sandtoft Danum TLE tile colour dark grey REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 4 | Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 5 | The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan. |
| 6 | In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 7 | Off-Site Highway Works The development hereby permitted shall not come into use or be occupied until the highway works detailed below have been carried out in accordance with such plans that are subsequently submitted to and approved in writing by the Local Planning Authority: a) Removal of the existing vehicular access asphalt construction on Lingdale Road and replaced with concrete construction in line with the Tees Valley Design Guide & Specification, b) Subbase to be renewed with Type 1 stone at a depth of no less than 225mm, c) Existing channel kerbs to be renewed and / or replaced where damaged between carriageway and vehicular access, d) Edge retention to be installed between concrete vehicular access and private access road; and, e) Renewal of ‘SLOW’ and associated road markings within a 100m radius of the access. REASON: In the interests of providing a safe means of access to the site by all modes of transport and to, minimise disruptions to the free flow of traffic having regard for Local plan policy and sections 9 and 12 of the NPPF. |
| 8 | The proposed dwelling hereby approved shall only be used in conjunction with the business operating from the site and not as a separate dwelling unit. REASON: In order that the Local Planning Authority control development outside of development limits in accordance with Local Plan Policy SD3. |
| 9 | No external lighting shall be installed on site until plans showing the type of light appliance, the height and position of fitting, illumination levels and light spillage have been submitted to and approved in writing by the Local Planning Authority. The lighting approved shall be installed and maintained in accordance with the approved details. REASON: In the interests of the amenities of the area and to minimise unnecessary light spillage above and outside the development site in accordance with Policy SD4 of the Redcar and Cleveland Local Plan. |
| 10 | Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary. |
| 11 | The proposal will require alterations to the existing highway and as such will require an Agreement under Section 278 of the 1980 Highways Act The applicant is urged to consult early with the Highway Authority (tel: 07966 659 107) to discuss these proposals. This agreement must be completed and in place before work commences. |
| 12 | The high pressure gas pipeline(s) in the vicinity of the proposed development is / are registered as a “Major Accident Hazard Pipeline (s)” and as such are subject to the HSE’s Land Use Planning advice methodology, along with the Pipelines Safety Regulations 1996. |
