# Condition Details
1 No phase of development is to commence until a phasing plan has been submitted to the Local Planning Authority setting out the proposed sequence of development and any associated temporary operations. The development shall be completed in accordance with the approved details. Reason: For the avoidance of doubt.
2 Notwithstanding the details submitted, for each phase of development, details of external materials for permanent buildings and structures shall be submitted to the Local Planning Authority for approval in writing. The development shall not be carried out except in accordance with the approved details. Reason: In the interests of the appearance of the area in accordance with policy SD4 of the Redcar and Cleveland Local Plan.
3 Prior to the commencement of each phase of construction, a Construction Method Statement shall be submitted for that phase for approval in writing by the Local Planning Authority in consultation with the appropriate Highways Authority. The Statements shall provide for: - The parking of vehicles of site operative and visitors clear of the highway; - Loading and unloading of plant and materials; - Storage of plant and materials used in constructing the development; - Wheel washing facilities; - Details of hardstandings, including any internal access and haul roads and; - Final locations and design of conveyor footings and stanchions. The development shall be completed in accordance with the approved details. Reason: For the avoidance of doubt and in the interests of public health and public and highway safety in accordance with policy SD4 of the Redcar and Cleveland Local Plan.
4 No phase of the authorised development is to commence, including any preparatory earthworks or site levelling but excluding ecological mitigation works, until a Construction Environmental Management Plan (“CEMP”) for that phase of the development, and incorporating the mitigation identified in the Environmental Statement (RHDHV, 8 February 2024) and Addendum to the Environmental Statement (RHDHV, 28 November 2024), has been submitted to and approved by the local planning authority. The plan must include details of the following: (a) a stakeholder communications plan; (b) details of the methods to control noise arising from construction activities (including temporary acoustic fencing); (c) details of the methods to be used to control dust and other emissions from the site including a Dust Management Plan; (d) details of all temporary fencing, temporary buildings, compound areas and parking areas including arrangements for their removal following completion of construction; (e) details of areas to be used for the storage of plant and construction materials and waste; (f) details of the facilities to be provided for the storage of fuel, oil and other chemicals, including measures to prevent pollution; (g) details of any temporary lighting arrangements (h) measures to ensure that construction vehicles do not deposit mud on any highway; (i) details of mitigation measures to protect biodiversity interests within the site and adjacent to it during the construction phases; (j) advisory signage at public access points advising of possible hazards including the potential for sudden noise; (k) asbestos management strategy (if needed); (l) details of measures to identify and mitigate gas risk; (m) a materials management plan and; (n) protocol for archaeological discovery. Unless otherwise agreed in writing with the local planning authority, all construction works must be carried out in accordance with the approved CEMP. Reason: In the interests of biodiversity, public health and public and highway safety in accordance with policy SD4 of the Redcar and Cleveland Local Plan.
5 Prior to each phase of development involving piling, a piling risk assessment will be submitted for approval by the Local Planning Authority. This will detail specific risk and mitigation methods for the piling works, alongside the management of pile arisings. The piling works shall thereafter be undertaken in accordance with the approved details. Reason: In the interests of public safety in accordance with policy SD4 of the Redcar and Cleveland Local Plan.
6 Prior to each phase of development, a Construction Traffic Management Plan shall be submitted to and approved in writing by the local planning authority (in consultation with National Highways). Construction of the development shall then be carried out in accordance with the agreed Construction Traffic Management Plan. Details shall include (but not limited to) construction shift times, road closure details and Abnormal Loads. Reason: To mitigate any adverse impact from the development on the A1053 in accordance with DfT Circular 01/2022.
7 A. Submission of Remediation Scheme Prior to each phase of construction, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. B. Implementation of Approved Remediation Scheme The approved remediation scheme must be carried out in accordance with its terms unless otherwise agreed in writing by the Local Planning Authority. Remediation shall be completed prior to the end use of the development. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a validation report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority. C. Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority REASON: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
8 Prior to the commencement of each phase of development, a surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological and hydro geological context of the development, shall be submitted to and approved in writing by the Local Planning Authority. Where the drainage system discharges into a surface water body, the drainage strategy should demonstrate the surface water run-off rates from the impermeable areas of the site during and following construction are limited to greenfield rates. The scheme shall be implemented in accordance with the approved details and thereafter be maintained. Reason: Required to prevent the increased risk of flooding, both on and off site from the outset of the project and to minimise the risk of contamination of the surface water drainage system during the construction process.
9 Prior to the commencement of each phase of development, or in such extended time that may be agreed with the Local Planning Authority, details of a Surface Water Drainage Management & Maintenance Plan shall be submitted and approved by the Local Planning Authority. The Management & Maintenance Plan shall include; (i) The timetable and phasing for construction of the drainage system (ii) Details of any control structure(s) (iii) Details of surface water storage structures (iv) Measures to control silt levels entering the system and out falling into any watercourse during the construction process (v) A plan clearly identifying the sections of surface water system that are to be adopted (vi) Arrangements for the short and long term maintenance of any present SuDS elements of the surface water system The development shall, in all respects, be carried out in accordance with the approved Management & Maintenance Plan. Reason: To ensure that the surface water drainage infrastructure is maintained to minimise the risk flooding in the locality.
10 Prior to the commencement of the development hereby permitted, an Overall Biodiversity Gain Plan (‘the Overall BG Plan’) shall be submitted to and approved in writing by the local planning authority. The Overall BG Plan shall include the following information: - information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; - the pre-development biodiversity value of the onsite habitat; - the post-development biodiversity value of the onsite habitat; - any registered offsite biodiversity gain allocated to the development and the biodiversity and the biodiversity value of that gain in relation to the development; - any biodiversity credits purchased for the development; and - any such other matters as the Secretary of State may by regulations specify. REASON: To enhance biodiversity in accordance with the National Planning Policy Framework. Reason for pre commencement condition: To ensure the statutorily required Biodiversity Net Gain is achieved and in accordance with paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 Article 35 of the Town and Country Planning (Development Management Procedure) (England) Order 2015.
11 Following approval of the Overall Biodiversity Gain Plan, a Phase Biodiversity Gain Plan shall be submitted for approval prior to each phase of development. This shall include the following information: - the post-development biodiversity value of the onsite habitat for the phase of the development (which is the subject of the Plan); -the post-development biodiversity value of the onsite habitat for each other phase of development (whether begun or otherwise); -any registered offsite biodiversity gain allocated to the entire development and the biodiversity value of that gain for the development prior to submission of the phase plan; -any registered offsite biodiversity gain which is proposed to be allocated to the entire development and the biodiversity value of that gain in relation to the development; -any biodiversity credits purchased for the entire development prior to submission of the phase plan; -any biodiversity credits proposed to be purchased for the entire development; ans -any other such matters as the Secretary of State may by regulations specify. REASON: To enhance biodiversity in accordance with the National Planning Policy Framework.
