# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan received by the Local Planning Authority on 06/11/25 Proposed Site Plan received by the Local Planning Authority on 06/11/25 REASON: To accord with the terms of the planning application.
3 Prior to the installation of the replacement cranes hereby approved, final design details (including the paint finish) of the cranes shall be submitted to and approved in writing by the Local Planning Authority. The cranes shall be designed in accordance with the parameters set out within Table 2 of the Planning Design and Access Statement received by the Local Planning Authority on 03/11/2025. REASON: To ensure control of the final crane design in accordance with Policy SD4 of the Redcar and Cleveland Local Plan.
4 The construction of the replacement rail mounted cranes shall not commence until a detailed scheme for the disposal of surface water from the development hereby approved has been submitted to and approved in writing by the Local Planning Authority in consultation with the Lead Local Flood Authority. Thereafter the development shall take place in accordance with the approved details. REASON: To prevent the increased risk of flooding from any sources in accordance with the NPPF. REASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site it relates to drainage details which are often the first works on site and relate to site preparation.
5 Prior to the construction of the replacement rail mounted cranes commencing, a Construction Environmental Management Plan (CEMP) shall be submitted to and approved in writing by the Local Planning Authority. The approved CEMP shall be adhered to throughout the construction period. The Statement shall provide the following: i) The parking of vehicles for site operatives and visitors; ii) Loading and unloading of plant and materials; iii) Storage of plant and materials used in constructing the development; iv) Temporary contractors’ buildings, plant and lighting v) The erection and maintenance of security hoarding; vi) Wheel washing facilities; vii) Measures to control the emission of noise dust and vibration during the construction period. viii) A scheme for recycling/disposing of waste resulting from construction works. ix) A risk assessment of construction activities with potentially damaging effects on local ecological receptors including any measures to protect those receptors during construction x) Roles and responsibilities for the implementation of the CEMP requirements and measures REASON: To ensure the environmental effects of construction are appropriately managed and the potential risk to human health minimised as far as possible. REASON FOR PRE-COMMENCEMENT: A pre-commencement condition is required as the environmental impact of the development will occur on the commencement of development.
6 Prior to commencement of development, a Demolition Environmental Management Plan (DEMP) shall be submitted to and approved in writing by the Local Planning Authority. The approved DEMP shall be adhered to throughout the construction period. REASON: To ensure the environmental effects of construction are appropriately managed and the potential risk to human health minimised as far as possible. REASON FOR PRE-COMMENCEMENT: A pre-commencement condition is required as the environmental impact of the development will occur on the commencement of development.
7 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where remediation is necessary a remediation scheme must be prepared and submmited in writing to the Local Planning Authority for approval. The development shall thereafter be carried out in accordance with the approved remediation scheme. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
8 No demolition works associated with the development hereby approved shall be undertaken between October to March inclusive. REASON: To conserve protected species and their habitat in accordance with policy N4 of the Local Plan.
9 Prior to any decommissioning of the replacement rail mounted cranes hereby approved, a Decommissioning Management Plan (DMP) shall be submitted to and approved in writing by the Local Planning Authority. The approved DMP shall be adhered to throughout the decommissioning period. REASON: To ensure the environmental effects of decommissioning are appropriately managed and the potential risk to human health minimised as far as possible.
10 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
