# Condition Details
1 Prior to the commencement of the development, or in such extended time as may be agreed in writing with the Local Planning Authority, details shall be submitted and approved of the surface water drainage scheme and the development shall be completed in accordance with the approved scheme. The design of the drainage scheme shall include; (i) Confirmation of the suitability of the surface water disposal (receptor or infiltration to the ground). (ii) Details of how any impermeable area associated with the compound will be managed. (iii) Restriction of surface water greenfield run-off rates (QBAR value) with sufficient storage within the system to accommodate a 1 in 30 year storm. (iv) The method used for calculation of the existing greenfield run-off rate shall be the ICP SUDS method. The design shall also ensure that storm water resulting from a 1 in 100 year event, plus climate change surcharging the system, can be stored on site with minimal risk to persons or property and without overflowing into drains, local highways or watercourses. (v) Full Micro Drainage design files (mdx files) including a catchment plan (vi) The flow path of flood waters for the site as a result on a 1 in 100 year event plus climate change REASON: To ensure the development is supported by a suitably designed surface water disposal infrastructure scheme and to minimise the risk flooding in the locality.
2 Prior to the commencement of the development, or in such extended time that may be agreed with the Local Planning Authority, details of a Surface Water Drainage Management Plan shall be submitted and approved by the Local Planning Authority. The Management Plan shall include; (i) The timetable and phasing for construction of the drainage system (ii) Details of any control structure(s) (iii) Details of surface water storage structures (iv) Measures to control silt levels entering the system and out falling into any watercourse during the construction process The development shall, in all respects, be carried out in accordance with the approved Management Plan. REASON: To ensure the development is supported by an appropriately designed surface water disposal infrastructure scheme and to minimise the risk of increased flooding and contamination of the system during the construction process.
3 Prior to the development hereby approved being brought into operation, a Landscape and Biodiversity Management Plan shall be submitted to and approved in writing by the Local Planning Authority. The Landscape and Biodiversity Management Plan submitted shall be in substantial accordance with the Outline Landscape and Biodiversity Management Plan (April 2024) submitted with the planning application. The Landscape and Biodiversity Management Plan shall be implemented as approved. REASON; To ensure the delivery of appropriate mitigation and compensation for habitat loss or temporary disturbance of habitats as identified in the conclusions of the submitted ecological assessment and associated ecological information.
4 No development shall take place until a Habitat Management and Monitoring Plan (HMMP) has been submitted to and approved in writing by the Local Planning Authority. The HMMP shall be prepared in accordance with the approved Biodiversity Gain Plan and include: (i) A non-technical summary; (ii) the roles and responsibilities of the people or organisation(s) delivering the HMMP; (iii) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (iii) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan; and (iv) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. The works shall be implemented and maintained in accordance with the approved HMMP for the designated period. REASON; To deliver Biodiversity Net Gain enhancements across the site in accordance with Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021) and Policy N4 of the Cleveland and Redcar Local Plan.
5 Prior to the importation of the first inert material or the carrying out of engineering operations at the site, protective fencing and ground protection measures shall been installed around trees to be retained as part of the development. The approved fencing /root protection shall be in place before any equipment, machinery or materials are brought on to the site and shall be maintained until the completion of the development. Within the fenced area(s) none of the following activities shall be carried out at any time; (i) erection or storage of scaffolding; (ii) stockpiling of materials or soil over root systems (iii) parking or operation of plant and machinery over root systems (iv) manoeuvring of plant and machinery over root systems, (v) changes to soil levels (vi) excavation of trenches, siting of ancillary buildings or (vii) fires lit The tree protection works shall be carried out in accordance with BS5837 ' Trees in Relation to Design, Demolition and Construction. If any retained tree is removed, uprooted or destroyed or dies, another tree shall be planted at the same place and that tree shall be of such size and species, and shall be planted at such time, as may be specified in writing by the council. Reason: To protect the retained trees from damage during construction, including all ground works and works that may be required by other conditions
