| 6 | A full 4 stage road safety audit carried out in accordance with guidance set out in the DMRB GG119 and guidance issued by the council, which will be required for the highway layout requiring alteration as specified in submitted drawings: ‘ENV0002570C-JAC-00-3SK-DR-PL-0003 - Proposed Overall General Arrangement Key Plan’ and ‘ENV0002570C-JAC-ZZ-3SK-SK-RD-0001 - Proposed Longitudinal Sections at Zetland Road Bridge Plan’ or such plans which are subsequently submitted to and approved in writing by the Local Planning Authority. Any remedial works required within the audit shall be implemented within 1 year of being identified within the audit, unless an alternative timescale is first agreed in writing with the Local Planning Authority. REASON To minimise the road safety risks associated with the changes imposed by the development having regard for Local Plan Policy and sections 9 and 12 of the NPPF. |
| 7 | The development hereby approved shall not be commenced until a detailed method of works statement has been submitted to and approved in writing by the Local Planning Authority. Such statement shall include at least the following details; Statement shall provide the following; a) Routing of construction traffic, including signage where appropriate; b) Any temporary access arrangements; c) Arrangements for site compound and contractor parking; d) Loading and unloading of plant and materials; e) Storage of plant and materials used in constructing the development; f) The erection and maintenance of security hoarding including decorative displays; g) Wheel washing facilities; Measures to prevent the egress of mud and other detritus onto the public highway; h) Methods of demolition; i) Measures to control the emission of noise dust and vibration during the construction period; j) A jointly undertaken dilapidation survey of the adjacent highway; k) Program of works; l) Details of any road/footpath closures as may be required, and m) The working hours for all construction activities on this site are limited to between 0800 and 1800 Mondays to Friday and 0800 to 1300 Saturdays and not at all on a Sunday or Public Holiday. The development must be carried out in accordance with the approved details, unless otherwise agreed in writing by the Local Authority. REASON To ensure that the development can be carried out in a manner that will not be to the detriment of amenity of local residents, free flow of traffic or safety of highway users having regard for Local Plan policy. |
| 8 | No development shall take place until a construction management plan has been submitted to, and approved in writing by, the Local Planning Authority (LPA). The construction management plan shall be carried out as approved and any subsequent variations shall be agreed in writing by the LPA. The scheme shall include the following elements: • General pollution prevention measures • Details of site management responsibilities • A biosecurity plan, considering presence of invasive non-native species and the possibility of introducing or spreading them to/from the site REASON: To ensure the protection of wildlife and supporting habitat in line with national planning policy. The construction phase of the bridge installation proposed as part of this development could have an unacceptable effect on the ecological value of the Skinningrove Beck at this site. |
| 9 | No development shall take place until a plan detailing the protection of otter, a protected species under The Wildlife and Countryside Act 1981 as amended Natural Environment and Rural Communities Act 2006, and its associated habitat, has been submitted to and approved by the LPA. The plan must consider the whole duration of the development, from the construction phase through to development completion. Any change to operational responsibilities, including management, shall be submitted to, and approved in writing by, the LPA. The otter protection plan shall be carried out in accordance with a timetable for implementation as approved. The scheme shall include the following elements as set out in the Non-Statutory Environmental Report: • Sensitive management of excavations to prevent entrapment • Management of machinery, equipment, and chemicals to prevent spills • Avoidance of night time working where practicable • Where working in darkness is unavoidable, implementation of a sensitive lighting scheme to avoid disturbance of otter In addition, not listed within the Non Statutory Environmental Report, the otter protection plan should include the provision of a pre-works checking survey to ensure that conditions on the site have not changed since the baseline survey, and outline a procedure to follow in the event that otter are encountered during the works to prevent harm or disturbance. This plan should form part of a Construction Environment Management Plan (CEMP). REASON: To protect the otter and its habitat within the development site, and to avoid damaging the site’s nature conservation value. The otter is a protected species/habitat under the Wildlife and Countryside Act (1981, as amended) and is also listed under Section 41 of the Natural Environment and Rural Communities Act (NERC, 2006) and is believed to be present at the proposed development site. Limited evidence of otter was recorded during the surveys, indicating that it is unlikely otter will be impacted by the works. However, there remains a low-level risk of otter being negatively affected. |
| 10 | a) Implementation of Approved Remediation Scheme The remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority. b) Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirements of part (a) and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of part (b), which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 11 | Development may not be begun unless: a biodiversity gain plan has been submitted to the planning authority; and the planning authority has approved the plan. The biodiversity gain plan must include : - information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; - the pre-development biodiversity value of the onsite habitat; - the post-development biodiversity value of the onsite habitat; - any registered offsite biodiversity gain allocated to the development and the biodiversity and the biodiversity value of that gain in relation to the development; - any biodiversity credits purchased for the development; and - any such other matters as the Secretary of State may by regulations specify. Reason: To enhance biodiversity in accordance with the National Planning Policy Framework. Reason for pre commencement condition: To ensure the statutorily required Biodiversity Net Gain is achieved and in accordance with paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 Article 35 of the Town and Country Planning (Development Management Procedure) (England) Order 2015. |
| 12 | The development shall not commence until a [Habitat Management and Monitoring Plan (the HMMP)], prepared in accordance with the approved Biodiversity Gain Plan has been submitted to, and approved in writing by, the local planning authority and including: (a) a non-technical summary; (b) the roles and responsibilities of the people or organisation(s) delivering the [HMMP]; (c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and (e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. REASON: To ensure the delivery of biodiversity net gain on site. |
| 13 | Within twelve months of the commencement of development details of the replacement play area shall be submitted to and approved in writing with the Local Planning Authority. The details shall include details of the layout and equipment to be provided along with a timeline for the implementation of the play area. The replacement play area shall be implemented in accordance with the approved details. REASON: To ensure the provision of a replacement play area. |
