3 Prior to the first occupation of each individual dwelling, hereby approved, details of the boundary treatment for each dwelling shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details and the boundary treatments shall thereafter be maintained unless the express consent of the Local Planning Authority is given. REASON: To ensure that any boundary treatments would accord with policy SD4 of the Redcar and Cleveland Local Plan by respecting the character of the site and the surroundings and raising no significant adverse impact on neighbouring occupiers.
4 Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
5 Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
6 The development hereby approved shall be carried out in accordance with the submitted Levels Plan (Drawing No. 5143-QBD-XX-M2-A-2170_100_048)1 – ‘Levels Plan’ received by the Local Planning Authority on 05/05/2026. REASON: To ensure a satisfactory relationship between existing and proposed buildings in accordance with policy SD4 of the Local Plan.
7 Development shall not commence until a detailed scheme for the disposal of foul and surface water from the development hereby approved has been submitted to and approved in writing by the Local Planning Authority in consultation with Northumbrian Water and the Lead Local Flood Authority. Thereafter the development shall take place in accordance with the approved details. REASON: To prevent the increased risk of flooding from any sources in accordance with the NPPF. REASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site it relates to drainage details which are often the first works on site and relate to site preparation.
8 Prior to occupation of the first completed dwelling on the site a landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority. The details shall include size, type and species and a programme of work. The development shall be completed in accordance with the approved details. REASON: To ensure that the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
9 All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in accordance with a phasing programme to be submitted to and agreed in writing with the Local Planning Authority prior to any development above damp proof course. Any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
10 Development may not be begun unless: a Biodiversity Gain Plan has been submitted to the planning authority; and the planning authority has approved the plan. The Biodiversity Gain Plan must include : - information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; - the pre-development biodiversity value of the onsite habitat; - the post-development biodiversity value of the onsite habitat; - any registered offsite biodiversity gain allocated to the development and the biodiversity and the biodiversity value of that gain in relation to the development; - any biodiversity units purchased for the development; and - any such other matters as the Secretary of State may by regulations specify. Reason: To enhance biodiversity in accordance with the National Planning Policy Framework. Reason for pre commencement condition: To ensure the statutorily required Biodiversity Net Gain is achieved and in accordance with paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 Article 35 of the Town and Country Planning (Development Management Procedure) (England) Order 2015.
11 The development shall not commence until a Habitat Management and Monitoring Plan (the HMMP), prepared in accordance with the approved Biodiversity Gain Plan has been submitted to, and approved in writing by, the local planning authority and including: (a) a non-technical summary; (b) the roles and responsibilities of the people or organisation(s) delivering the HMMP; (c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and (e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. REASON: To ensure the delivery of biodiversity net gain on site.
12 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development Reason : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors
13 Prior to commencement of construction, a CEMP shall be submitted to and approved in writing by the Local Planning Authority. The approved Statement shall be adhered to throughout the construction period. The Statement shall provide the following; a) Routing of construction traffic, including signage where appropriate; b) Any temporary access arrangements; c) Arrangements for site compound and contractor parking; d) Loading and unloading of plant and materials; e) Storage of plant and materials used in constructing the development; f) The erection and maintenance of security hoarding including decorative displays; g) Wheel washing facilities; Measures to prevent the egress of mud and other detritus onto the public highway; h) Methods of demolition; i) Measures to control the emission of noise dust and vibration during the construction period. J) A scheme for recycling/disposing of waste resulting from demolition and construction works. k) A jointly undertaken dilapidation survey of the adjacent highway; l) Program of works; and, m) Details of any road/footpath closures as may be required. REASON: To protect the amenity of nearby residents and in the interests of highway safety in accordance with Local Plan Policy SD4. REASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site it relates to site details which are often the first works on site and relate to site preparation.
14 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan.
15 All sound attenuation measures required for a dwelling detailed in the noise assessment (Report reference: NJD25-0072-001R) supplied shall be fully implemented and validated for that dwelling prior to the dwelling being brought into permitted end use and permanently retained thereafter. REASON: In the interest of occupier amenity.
16 No development shall take place in the area outlined in red in the plan within the consultee response from NEAR Consultancy dated 06/02/2026 until a written scheme of investigation (WSI) for archaeological work in the area has been submitted to and approved in writing by the local planning authority. The WSI shall as a minimum make provision for: (a) An archaeological watching brief of all ground disturbance extending 300mm or more below ground level during construction groundworks in the area outlined in red in the plan within the consultee response from NEAR Consultancy dated 06/02/2026. (b) Provision for the analysis, archiving and publication of the results of watching briefs shall be secured to the satisfaction of the local planning authority by the developer before the development is occupied. (c) The development shall not without the prior written approval of the local planning authority be carried out otherwise than in accordance with the approved WSI. REASON: To ensure suitable consideration of the site with regard to archaeological matters in accordance with Policy HE3 of the Redcar and Cleveland Local Plan.
17 The development hereby approved shall be completed in accordance with the recommendations as detailed within Chapter 6 of the Ecological Impact Assessment (May 2026) received by the Local Planning Authority on 22/05/2026. REASON: To protect ecology within the site in accordance with Local Plan Policy N4.
18 Fully detailed drawings illustrating the design and materials of roads, footpaths, traffic calming, shared space and other adoptable open spaces shall be submitted to and approved in writing by the Local Planning Authority prior to the start of construction of said of roads, footpaths, traffic calming, shared space and other adoptable open spaces on site. The development shall be carried out in accordance with the approved details. Reason; To ensure a satisfactory form of development and in the interests of highway safety having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
19 No dwelling to which this planning permission relates shall be occupied unless or until the carriageway base course and kerb foundation to the new estate road and footpath to which it fronts, is adjacent to or gains access from, has been constructed. Road and footway wearing courses and street lighting shall be provided within 6 months of the date of commencement on the construction of the penultimate dwelling of the development. Reason: To ensure appropriate access and egress to the properties, in the interests of highway safety and the amenity of residents having regard Local Plan Policy and sections 9 and 12 of the NPPF.
20 The development hereby permitted shall not be occupied until the highway works for vehicular access to the site have been carried out in accordance with the submitted drawing ‘5143-QBD-XX-DR-A-2170_100_011_02-Site Layout Planning Version REV H’, or such plans which are subsequently submitted to and approved in writing by the Local Planning Authority. The provision of a 2m footway on the northern edge of Marske Road along the entirely of the site boundary and the provision of a bus shelter as proposed on the above named drawing will be completed prior to the occupation of 31st dwelling. REASON: In the interests of providing a safe means of access to the site by all modes of transport and to, minimise disruptions to the free flow of traffic having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
21 A full 4 stage road safety audit shall be carried out in accordance with guidance set out in the DMRB GG119 and guidance issued by the council, will be required for the internal highway layout and all off-site works requiring alteration as shown on ‘5143-QBD-XX-DR-A-2170_100_011_02-Site Layout Planning Version REV H’ or such plans which are subsequently submitted to and approved in writing by the Local Planning Authority. Stage 2 of said audit must be submitted to and confirmed in writing by the Local Planning Authority prior to the highway works commencing on site. Any works recommended by the audit, if validated in conjunction with the Highway Authority consultation comments, shall be implemented within 6 months following the works being identified and agreed by the Highways Authority, or unless an alternative timescale is first agreed in writing with the Local Planning Authority. REASON: To minimise the road safety risks associated with the changes imposed by the development having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
22 The development hereby approved shall not be occupied until sightlines for vehicular parking on plots 12 and 57 have been provided. Such sightlines for all vehicular parking arrangements on the site shall be created and retained thereafter in perpetuity, free of all obstructions over 600mm in height above the level of the adjacent highway. Reason: To ensure an adequate level of visibility is provided in accordance with the relevant criteria so that the use of said highway/junction does not prejudice the free flow of traffic or safety of highway users having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
23 The development hereby approved shall be completed in accordance with the Energy and Sustainability Statement (March 2026) received by the Local Planning Authority on 30/03/26 unless otherwise agreed in writing with the Local Planning Authority. REASON: To ensure the development complies with Policy SD4 (l) of the Redcar and Cleveland Local Plan.
24 The development shall not be occupied until a Management & Maintenance Plan for the surface water drainage scheme has been submitted to and approved by the Local planning Authority; the plan shall include details of the following; (i) A plan clearly identifying the sections of surface water system that are to be adopted (ii) Arrangements for the short and long term maintenance of the SuDS elements of the surface water system REASON: To ensure that the surface water drainage infrastructure is maintained to minimise the risk flooding in the locality.
25 Informative Note: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
26 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
