| 1 | Details of the access, appearance, landscaping, layout and scale, (hereinafter called "the reserved matters") shall be submitted to the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters and required to be imposed pursuant to Sections 91 and 92 of the Planning & Compulsory Purchase Act 2004. |
| 2 | The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last of the reserved matters to be approved, whichever is later. REASON: Required to be imposed pursuant to Sections 91 and 92 of the Planning & Compulsory Purchase Act 2004. |
| 3 | The development hereby permitted shall be carried out in accordance with the following approved plans: - Location plan and site plan received by the Local Planning Authority on 27/06/2025 - Proposed front and side elevation received by the Local Planning Authority on 04/12/2025 - Proposed rear and side elevation received by the Local Planning Authority on 24/11//2025 - Proposed ground floor plan received by the Local Planning Authority on 16/07/2026 - Proposed first floor plan received by the Local Planning Authority on 16/07/2026 - Proposed second floor plan received by the Local Planning Authority on 16/07/2026 - Proposed third floor plan received by the Local Planning Authority on 16/07/2026 - Proposed fourth floor plan received by the Local Planning Authority on 16/07/2026 REASON: To accord with the terms of the planning application. |
| 4 | Prior to commencement of construction, a CEMP shall be submitted to and approved in writing by the Local Planning Authority. The approved Statement shall be adhered to throughout the construction period. The Statement shall provide the following; i) The parking of vehicles for site operatives and visitors; ii) Loading and unloading of plant and materials; iii) Storage of plant and materials used in constructing the development; iv) The erection and maintenance of security hoarding including decorative displays; v) Wheel washing facilities; vi) Methods of demolition; vii) Measures to control the emission of noise dust and vibration during the construction period. viii) A scheme for recycling/disposing of waste resulting from demolition and construction works. ix) Details of any road/footpath closures as may be required. REASON: To protect the amenity of nearby residents and in the interests of highway safety. EASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site as it relates to site preparation. |
| 5 | The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan. |
| 6 | Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 7 | The development hereby approved shall not be occupied until secure cycle parking facilities have been approved in writing by the Local Planning Authority and installed. Such drawings must show the position, design, materials and finishes thereof. Thereafter the cycle parking facilities shall be retained in perpetuity for the sole purpose of parking cycles. REASON: To promote use of cycles reducing traffic congestion and in the interests of the amenities of residents to ensure a satisfactory form of development having regard for Local Plan Policy SD4 and sections 9 and 12 of the NPPF. |
| 8 | The development hereby approved shall not be occupied until the refuse/recycling store has been provided in accordance with the approved site plan 'Proposed Ground Floor Plan Dwg: 005' dated 06/02/26, or such plans which are subsequently submitted to and approved in writing by the Local Planning Authority. Such drawings to show the position, design, materials and finishes thereof. Thereafter the refuse/recycling store shall be retained in perpetuity for the sole purpose of refuse/recycling storage. Reason: In the interests of the amenities of residents to ensure a satisfactory form of development having regard for Local Plan Policy and section 12 of the NPPF. |
| 9 | Notwithstanding the parking details contained within this application, the development hereby approved shall not be occupied until a car parking layout including vehicle tracking illustrating sufficient space for the turning and manoeuvring of vehicles within the site is submitted to and approved in writing by the Local Planning Authority. Such areas shall thereafter be retained in perpetuity for the sole purpose of parking vehicles and vehicular access to the ground floor commercial units. The car parking details shall include details of how the area is to be secured and allow access to existing commercial units. REASON; To ensure a satisfactory form of development and in the interests of highway safety having regard for Local Plan Policy SD4 and sections 9 and 12 of the NPPF. |
| 10 | Within 6 months of commencement of the development hereby permitted a formalised dropped crossing must be created to enable the safe movement of pedestrians from the proposed parking facility on to Central Terrace, this can be actioned either in accordance with plans which are subsequently submitted to and approved in writing by the Local Planning Authority and permissions granted under the Highways Act, or works undertaken directly with the highways authority. Reason: In the interests of providing a safe means of access to the site by all modes of transport and to, minimise disruptions to the free flow of traffic in accordance with Local Plan Policy SD4. |
| 11 | Dropped Kerb - Section 184 The permission hereby granted should not be construed as authority to work within the public highway. Highways consent is required for the creation/alteration of a dropped vehicle crossing under Section 184 of the 1980 Highways Act. Such works will need to be carried out at the applicant's expense by Redcar & Cleveland Borough Council or approved contractors. The applicant is advised that prior to the commencement of works on site they should contact the Highway Authority (01642 455 600). |
| 12 | Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated. |
