2 No part of the development hereby permitted shall be occupied until an Operational Management Plan has been submitted to and approved in writing by the Local Planning Authority (in consultation with the Highway Authority for the A1053 and A174) and implemented. The development hereby permitted shall then be operated in accordance with the agreed Operational Management Plan. Details shall include (but not be limited to) the definition of shift times for employees. REASON: To ensure that the A174 & A1053 trunk roads continue to serve their purpose as part of a national system of routes for through traffic in accordance with Section 10 (2) of the Highways Act 1980, and in the interests of highway safety.
3 The development will not be occupied until the hazardous substances consents at the Teesside site of the South Tees Site Company Ltd have been revoked in their entirety under the provisions of the Planning (Hazardous Substances) Act 1990, and written confirmation of the necessary revocations has been issued by the Hazardous Substances Authority. REASON: To ensure there is no planning entitlement for the presence of hazardous substances which could, if taken up, present inadvisable risks to people based at the development.
4 Prior to the first occupation of any building of the completed development hereby approved a full Travel Plan must be submitted to and approved in writing by the Local Planning Authority. The approved Travel Plan shall be implemented prior to the development being brought into use and thereafter be operated in accordance with the approved Travel Plan unless agreed otherwise in writing by the Local Planning Authority. REASON: To promote sustainable transport measures for visitors and staff having regard for Local Plan Policy and NPPF.
5 Prior to the first occupation of any building of the completed development hereby approved a scheme of sustainable transport accessibility that links to the proposed development from the highway network, in conjunction with a suitable Travel Plan, shall be submitted to and approved in writing by the Local Planning Authority. Such areas offered as a means of sustainable transport accessibility shall built prior to the proposed development being brought into use and thereafter be retained in perpetuity for the provision of sustainable transport access. Reason; To ensure a satisfactory form of development having regard for Local Plan Policy and NPPF.
6 The development hereby approved shall not be brought into use until a plan and implementation timetable for cycle parking and storage has been submitted to and approved in writing by the Local Planning Authority. The approved details should be constructed prior to the building being brought into use in accordance with the approved implementation timetable, and thereafter such areas shall be retained solely for such purposes. REASON: To ensure a satisfactory form of development having regard for Local Plan Policy and NPPF.
7 Prior to the commencement of development of any substation detailed on the Key Masterplan (Dwg No. SD-10.03) received by the Local Planning Authority on 03/06/25, final details of the floor plans and elevations of the substation(s) shall be submitted to and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To provide the detailed design of these elements of the scheme.
8 Prior to any development above damp proof course on any building, details of the external materials to be used in the construction of that building shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
9 Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
10 Prior to the development hereby approved becoming operational a greenhouse gas assessment shall be undertaken in respect of the operation of the proposed buildings. It shall be submitted to and approved in writing by the Local Planning Authority. Measures set out within the assessment shall be complied with thereafter, unless otherwise agreed in writing. REASON: To ensure the environmental effects of the development are appropriately managed.
11 All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
12 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
13 Informative Note - The applicant is advised that there are a number of conditions on the outline approval (R/2020/0821/ESM) that are required to be discharged at various trigger points including prior to the commencement of development. The applicant should ensure that the conditions are discharged at the appropriate time and thereafter the development implemented in accordance with the approved details.
14 2. Informative Note - The applicant is advised that the development hereby approved is required to be constructed in accordance with the Parameters Plan considered as part of the outline approval (R/2020/0821/ESM) and condition 4.
15 Informative Note - The applicant is reminded of the requirement to submit an updated Habitats Regulations Assessment in order to discharge condition 7 of the outline approval (R/2020/0821/ESM). The updated HRA may also be required in the discharge of other conditions relating to technical matters attached to the outline approval.
