# Condition Details
1 It is considered that the proposed lodge, by reason of its siting, size and design would have a significantly detrimental impact on the Nationally Important Landscape of the North Yorkshire and Cleveland Heritage Coast. The proposal does not accord with any of the criteria permitting development within the heritage coast. The appearance and siting of the lodge would be out of character of the area and the building would not protect the remote character and natural beauty. It is also considered the proposed access track across the applicant’s garden would have a detrimental impact on the sensitive landscape. The proposed development is contrary to Policy N1 and part j of Policy SD4 of the Redcar and Cleveland Local Plan.
2 The application has failed to address Biodiversity Net Gain which is contrary to Section 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021).
3 Statement of Co-operative Working: The Local Planning Authority considers that the application as submitted did not meet with the local policies and guidance. The applicant / agent has been advised of the concerns however as the principle of the proposal is unacceptable a revision wasnt considered applicable.
