| 3 | Notwithstanding the provisions of Part 1 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) no development within the following classes shall be carried out unless an application has first been submitted to and approved by the Local Planning Authority; Class A - Enlargement, improvement or other alteration of a dwellinghouse Class B - Additions etc to the roof of a dwellinghouse Class C - Other alterations to the roof of a dwellinghouse Class E - Buildings etc incidental to the enjoyment of a dwellinghouse REASON: The application site is located outside development limits defined in the development plan and in open countryside. The Local Planning Authority accepts that the change of use of the existing building will have a limited impact on the appearance and character of the countryside but considers it is necessary to remove residential permitted development rights for any alterations or extensions to the building so that it may exercise appropriate control over development that may further impact the appearance and character of the area. |
| 4 | For the purposes on interpreting condition (3) above the curtilage of the dwelling shall be that area defined on the submitted plan Drwg No RC/24/005/004 (Site Plan Showing Proposed Curtilage) received by the Local Planning Authority on 18 December 2024. REASON: The application site is located outside development limits defined in the development plan and in open countryside. The Local Planning Authority accepts that the change of use of the existing building will have a limited impact on the appearance and character of the countryside but considers it is necessary to remove residential permitted development rights for any alterations or extensions to the building so that it may exercise appropriate control over development that may further impact the appearance and character of the area. It was agreed with the applicant that it was appropriate to define that area to be considered the curtilage of the dwelling for the purposes of the exercise of future planning control. |
| 5 | Within 6 months of the date of this permission being granted, the existing access from the main highway shall be improved in accordance with detail to be submitted and approved by the Local Planning Authority in consultation with the Local Highway Authority; the access shall be improved in accordance with the approved details. REASON; In order the secure improvements to the exiting access to ensure that it meets the technical requirements for access to the new dwelling and in the interests of highway safety |
