# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Proposed site Plan Block Plan (ref S704(PL)03 received by the Local Planning Authority on 08.08.2024 Indicative existing and proposed Site Sections (ref S704(PL)07) received by the Local Planning Authority on 08.08.2024 Proposed Floor Plan and elevations (ref S704(PL)05 Rev A) received by the Local Planning Authority on 27.08.2024 REASON: To accord with the terms of the planning application.
3 The development hereby permitted shall not come into use until the highway works detailed below have been carried out in accordance with the submitted drawing ‘S704(PL) 03 - Proposed Site Plan Opt B’ or such plans which are subsequently submitted to and approved in writing by the Local Planning Authority: a) Renewal and relocation of radius kerbs; b) Resurfacing of footway; c) Reconstruction of the carriageway at the point of access including resurfacing as required; d) Renewal of tactile paving; and, e) Road lining. Reason: In the interests of providing a safe means of access to the site by all modes of transport and to, minimise disruptions to the free flow of traffic having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
4 No part of the development hereby approved shall be brought into use until a plan showing the location and provision for cycle parking has been provided, constructed, and laid out in accordance with such plans approved in writing by the local planning authority, and thereafter such areas shall be retained solely for such purposes. Reason; To ensure a satisfactory form of development and in the interests of highway safety having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
5 Prior to the commencement of construction details of a dust mitigation strategy for the construction phase of the development shall be submitted to the Local Planning Authority for approval in writing. The approved strategy shall be implemented in its entirety and maintained throughout the period of construction. REASON: In the interests of neighbour amenity.
6 The working hours for all construction and demolition activities on this site are limited to between 08:00 and 18:00 Mondays to Fridays and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holidays. REASON: In the interest of neighbour amenity.
7 Unless otherwise approved in writing by the Local Planning Authority the Air Handling Units installed shall be in accordance with the details withing the Noise Impact Assessment (prepared by Professional Consult Future Environments Dated 2 July 2024). Reason In the interest of residential amenity and in accordance with Policy SD4 of the Redcar and Cleveland Local Plan 2018
8 The development hereby approved shall be completed in accordance with the habitat management recommendations included at section 8.2 of the submitted Biodiversity Net Gain Report received by the Local Planning Authority on 08/08/2024. REASON: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
9 Monitoring reports shall be submitted to local planning authority in writing in accordance with the methodology and frequency specified in the section 8.3 of the submitted Biodiversity Net Gain Report received by the Local Planning Authority on 08/08/2024. Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
10 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
11 The proposal will require alterations to the existing highway and as such will require an Agreement under Section 278 of the 1980 Highways Act. The applicant is urged to consult early with the Highway Authority (tel: 01642 455 600) to discuss these proposals. This agreement must be completed and in place before work commences.
