# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan received by the Local Planning Authority on 10/07/2025 Proposed site Plan (2417 Lal XX 00 DR A 00 201 P4) received by the Local Planning Authority on 10/07/2025 Proposed Block Plan (2417 Lal XX Xx DR A 00 200 P6) received by the Local Planning Authority on 10/07/2025 Proposed Floor Plans (Wrbe 1532 A) received by the Local Planning Authority on 10/07/2025 Proposed elevations (Wrbe 1532 A) received by the Local Planning Authority on 10/07/2025 Proposed Ramp (2417 Lal XX 00 DR A 00 600P1) received by the Local Planning Authority on 10/07/2025 REASON: To accord with the terms of the planning application.
3 The building hereby permitted shall be removed on or before 01/04/2030 in accordance with a scheme of work, including any restoration of the land, which shall be submitted to and approved, in writing, by the Local Planning Authority, unless the prior consent of the Local Planning Authority has been obtained for an extension to the period of validity. REASON: To ensure an appropriate restoration of the site in order to respect the character and appearance of the area in accordance with policy SD4 of the Local Plan.
4 The development (including related installation of utilities or creation of access) shall be carried out in accordance with the approved WSI. Unless agreed otherwise by the LPA in accordance with a variation of the WSI no part of the development (or of utilities or access creation) causing disturbance at 300mm or more below ground level shall be exempt from this requirement. A programme for archaeological monitoring of the removal of all roots of trees permitted to be felled as part of the development (including recording of deposits, taking samples, and conserving finds) shall be agreed by the developer with an appropriate archaeological contractor and provided to the Council not less than 21 days before the time of removal of the roots. The agreed programme shall ensure that the results of the monitoring are available for discussion between the developer and the Council before the commencement of ground disturbance for construction of the building, utilities or any access. As informed by the above monitoring, the scope and requirements of the watching brief may be varied by the Council and the developer by agreement. Before ground disturbance for construction of the building, utilities or any access, commences on site the developer shall (i) appoint a contractor to carry out the watching brief, and (ii) notify the identity of the contractor and confirm to the Council in writing that appropriate contingencies for exceptional discoveries are in place (meaning human remains or exceptional finds, assemblages, structures or deposits). The development shall not be brought into use until provision has been secured to the satisfaction of the Council for the completion of the archaeological assessment and analysis of all relevant finds, material and/or deposits resulting from the execution of the watching brief. REASON: The site is likely to be of archaeological significance.
5 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority. REASON: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors
6 The development hereby approved shall be completed in accordance with the works schedule included at section 6 of the submitted Habitat Management and Monitoring Plan received by the Local Planning Authority on 24/02/2025. REASON: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
7 Monitoring reports shall be submitted to local planning authority in writing in accordance with the methodology and frequency specified in the section 7.1 of the submitted Habitat Management and Monitoring Plan received by the Local Planning Authority on 24/02/2025. REASON: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
8 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
