# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan (0001 P01) received by the Local Planning Authority on 03/04/2024 Proposed site Plan (1001 P04) received by the Local Planning Authority on 03/04/2024 Proposed site layout plan (1002 P04) received by the Local Planning Authority on 03/04/2024 Elevations (2177-R10-XX-XX-DR-W-2001-D3-P02) received by the Local Planning Authority on 03/04/2024 Ground Floor Layout (2177-R10-XX-XX-DR-W-1001-D3-P09) received by the Local Planning Authority on 03/04/2024 First Floor Layout (2177-R10-XX-XX-DR-W-1002-D3-P09) received by the Local Planning Authority on 03/04/2024 Roof Plan (2177-R10-XX-XX-DR-W-1009-D3) received by the Local Planning Authority on 03/04/2024 REASON: To accord with the terms of the planning application.
3 The building hereby permitted shall be removed and the land restored, in accordance with a scheme agreed in writing with the Local Planning Authority, on or before 01/11/2029 unless the prior consent of the Local Planning Authority has been obtained for an extension to the period of validity. REASON: To ensure an appropriate restoration of the site in order to respect the character and appearance of the area in accordance with policy SD4 of the Local Plan.
4 Within 6 months of the decision date of the development hereby approved final written confirmation shall be provided to the Local Planning Authority to demonstrate the purchase of the Bio-Diversity Net Gain (BNG) credits required to achieve 10% gain as identified within the BNG Report (2177-MAC-XX-XX-T-L-0001) received by the Local Planning Authority on 23/09/2024. REASON: To ensure the satisfactory purchase of credits to achieve Bio-diversity Net Gain.
5 Within 6 months of the decision date of the development hereby approved, covered and secure cycle parking facilities, for 24 cycles, shall be provided within the site. The cycle parking facilities shall be retained for the lifetime of the development for the sole purpose of parking cycles. REASON: To promote use of cycles reducing traffic congestion and in the interests of the amenities of residents to ensure a satisfactory form of development having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
6 Within 6 months of the decision date of the development hereby permitted the highway works detailed below shall have been carried out in accordance with plans which are submitted to and approved in writing by the Local Planning Authority: a. Removal and renewal of kerb lines on Burns Road; b. Installation of gullies or suitable drainage system; c. Carriageway and footway resurfacing; d. Amendment to the TRO and/or creation of a TTRO to facilitate the installation of parking restrictions, and; e. Installation of road lining; REASON: In the interests of providing a safe means of access to the site by all modes of transport and to, minimise disruptions to the free flow of traffic having regard for Local Plan Policy and sections 9 and 12 of the NPPF.
7 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
