| 3 | The development hereby approved must comply with the following requirements that: (i) the accommodation shall be occupied for holiday purposes only; (ii) the accommodation shall not be occupied as a person's sole, or main place of residence; (iii) the owners/operators shall maintain an up-to-date register of the names of all owners/occupiers of the accommodation, and of their main home addresses. The owner/operator shall advise the Local Planning Authority of the name and address of the holder of the records and shall make the information on the register available at all reasonable times to the Local Planning Authority REASON: Permanent residential living would have unacceptable impact on the amenity of the existing occupiers of 10 Dovecote Close contrary to Local Plan Policy SD4. |
| 4 | The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan. |
| 5 | In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development Reason : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors |
| 6 | The hot tub, sauna and gazebo hereby approved shall be constructed using timber externally. The gazebo roof shall be constructed with roof tiles to match the roof tiles of the Dovecote. REASON: To protect the character and appearance of the Marske Conservation Area and the setting of the Grade II listed Dovecote in accordance with Redcar and Cleveland Local Plan Policy HE1 and HE2. |
| 7 | The flue shall be finished in black and the finish shall be maintained thereafter. REASON: To safeguard the special character of the conservation area, the listed building and the setting of nearby listed buildings, as required by policies HE1 & HE2 of the adopted Local Plan. |
| 8 | Notwithstanding details contained within the application, the external wall hereby approved shall not be tied into the dovecote. The wall shall be constructed of reclaimed sandstone. REASON: To safeguard the special character and historic fabric of the listed building as required by policy HE2 of the adopted Local Plan. |
| 9 | Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary. |
| 10 | The applicant is advised that the property is located in a Smoke Control Area and it is an offence under the Clean Air Act 1993 for smoke to be emitted from a chimney in a Smoke Control Area unless authorised fuels are being burnt or the appliance is exempt. In a smoke control area only certain authorised fuels, or any of the following ‘smokeless’ fuels, can be burnt unless it is burnt in an exempt appliance: • anthracite • semi-anthracite • gas • low volatile steam coal Wood is not classed as an authorised fuel Therefore if the applicant wishes to install a solid fuel or wood burning appliance the appliance must be classified as an exempt appliance made in Regulations under the Clean Air Act 1993. In the event that the appliance is not classed as exempt then only authorised fuels should be used as stated above.
