# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan received by the Local Planning Authority on 22/01/24 Block Plan received by the Local Planning Authority on 22/01/24 Proposed Floor Plan received by the Local Planning Authority on 22/01/24 Proposed Elevations received by the Local Planning Authority on 22/01/24 REASON: To accord with the terms of the planning application.
3 Within 3 months of the date of the decision details of the equipment for ventilation and filtration to supress and disperse any fumes and/or smell created from the cooking operations on the premises, shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved scheme and shall thereafter be retained, operated and maintained in accordance with that approval. REASON: In the interests of the amenity of the area.
4 No external lighting shall be installed on site until plans showing the type of light appliance, the height and position of fitting, illumination levels and light spillage have been submitted to and approved in writing by the Local Planning Authority. The lighting approved shall be installed and maintained in accordance with the approved details. REASON: In the interests of the amenities of the area and to minimise unnecessary light spillage above and outside the development site.
5 The gross floorspace for the drinking establishment element of the development hereby approved shall be limited to no greater than the area detailed on the Proposed Floor Plan (Dwg Proposed Plans - Page 01) received by the Local Planning Authority on 22/01/24. REASON: To ensure the industrial use of the site is the primary use and the drinking establishment is subordinate to the main use to protect the vitality and viability of the industrial unit and wider industrial estate as required by Policies ED1 and ED6 of the Redcar and Cleveland Local Plan.
6 The drinking establishment and cafe/restaurant element of the development hereby approved shall only operate as an ancillary use in association with the primary use of the building as a brewery. Should the brewing element of the development cease, the drinking establishment and cafe/restaurant uses shall cease to be operate until the brewing activities re-commence. REASON: The drinking establishment and cafe restaurant uses are an ancillary use to the brewery and should the brewing use no longer be operational a sequentially preferable site should be sought for the town centre use in accordance with Policy ED6 of the Redcar and Cleveland Local Plan.
7 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
