# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: - Location plan received by the Local Planning Authority on 24/11/2023 - General site layout/site plan Amended 8.07.2024 received by the Local Planning Authority on 08/07/2024 - Services and associated details plan Amended 8.07.2024 - Proposed hut plan and elevations Amended 8.07.2024 - Landscaping scheme and boundary treatments Amended 8.07.2024 REASON: To accord with the terms of the planning application.
3 The development hereby approved must comply with the following requirements that: (i) the accommodation shall be occupied for holiday purposes only (ii) the accommodation shall not be occupied as a person's sole, or main place of residence (iii) the owners/operators shall maintain an up-to-date register of the names of all owners/occupiers of the accommodation, and of their main home addresses. The owner/operator shall advise the Local Planning Authority of the Name and address of the holder of the records and shall make the information on the register available at all reasonable times to the Local Planning Authority. REASON: The approved holiday accommodation is outside development limits and not considered large enough to accommodate permanent residential living. Holiday accommodation is in accordance with Local Plan Policy SD3
4 Nothwithstanding material and paint colour details contain in the 'Proposed hut plan and elevations' received by the local planning authority on 08/07/2024 all materials, including solar panel details and paint/stain details as part of the approved development shall first be agreed in writing with the Local Planning Authority before installation of the shepherd huts, hot tubs and pergolas. The structures shall be maintained in that condition in perpetuity unless otherwise agreed in writing with the Local Planning Authority. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 and HE2 of the Redcar and Cleveland Local Plan.
5 No external lighting shall be installed on site until plans showing the type of light appliance, the height and position of fitting, illumination levels and light spillage have been submitted to and approved in writing by the Local Planning Authority. The lighting approved shall be installed and maintained in accordance with the approved details. REASON: In the interests of the amenities of the area and to minimise unnecessary light spillage above and outside the development site in accordance with Policy SD4 of the Redcar and Cleveland Local Plan.
6 Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
7 Prior to (the first occupation of the shepherd huts hereby approved) a landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority. The details shall include size, type and species and a programme of work. The development shall be completed in accordance with the approved details. REASON: To ensure that the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
8 All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
9 The development hereby approved shall be carried out in accordance with the flood mitigation measures (finished floor levels and flood resilient design, flood warning and evacuation plan and surface water management) detailed within Chapter 6.2 of the Flood Risk Assessment) received by the local planning authority on the 11th January 2024. The mitigation measures shall be retained and maintained throughout the lifetime of the development. REASON: To protect future occupiers from flooding in accordance with Local Plan Policy SD7.
10 The use of the hot tubs hereby approved shall be carried out in accordance with the details contained in the 'Response to Environment Agency' document received by the local planning authority on 3rd April 2024. The hot tub wastewater should be managed in accordance with the document. The hot tub wastewater management measures shall be retained and maintained throughout the lifetime of the development. REASON: To protect the land from water pollution in accordance with local plan policy SD4 n.
11 The development hereby approved shall install the Tricel Novo package treatment plant details received by the local planning authority on the 26th April 2024. The Tricel Novo package treatment plant shall be retained and maintained throughout the lifetime of the development. REASON: To protect the River Tees from nutrient pollution.
12 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development REASON: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors
13 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan.
14 If the use of the log cabins hereby permitted for holiday purposes permanently ceases the shepherd huts, hot tubs and pergolas shall be removed from the land and the land shall, so far as is practicable, be restored to its condition before development took place within 12 months of the cessation. REASON: In order to return the land to its former condition and comply with the provisions of Policy SD3 of the Redcar and Cleveland Local Plan.
15 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
