| 3 | Prior to the development comencing a detailed acoustic report shall be submitted to and approved by the Local Planning Authority. The detailed acoustic report shall be carried out by a competent person and shall detail the existing noise climate at the development site. The aim of the report will be to establish whether sound attenuation measures are required to protect existing residents from the transferral of sound from the proposed premises. In the event that the acoustic report finds that the following noise levels would be exceeded, a noise insulation scheme shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be permanently retained whilst the permitted use continues. Reason: In the interest of neighbour amenity in accordance with Policy SD4 of the Local Plan. |
| 4 | The delivery and despatch of goods to and from the site shall be limited to the hours of 08:00 and 17:00 on Mondays to Fridays, 08:00 and 13:00 on Saturdays, and at no time on Sundays or Public Holidays. Reason: To ensure the retention of an environment free from intrusive levels of noise and activity in the interests of the amenity of the area in accordance with Policy SD4 of the Local Plan. |
| 5 | Prior to the development being brought into end a detailed odour impact assessment, to be carried out by a competent person in accordance with all relevant guidance and standards and of sufficiently robust design to suitably identify any odour/potential odour issues associated with the development. Should the assessment identify, that odour may detrimentally impact on residents, then an odour management plan must be provided stating the odour mitigating practices/equipment which is proposed to be installed/implemented. Reason: In the interest of neighbour amenity in accordance with Policy SD4 of the Local Plan. |
| 6 | Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 7 | Prior to development commencing a detailed method of works statement identifying the programming and management of site clearance/preparatory and construction works should be submitted to the LPA for information purposes. Such a statement shall include at least the following information; a) a programme of works b) the routing that will be promoted by the contractors to use main arterial routes and avoid the peak network hours b) where contractors will park c) where materials will be stored within the site d) measures employed to ensure no mud/detritus is dragged out over the adjacent highway e) a jointly undertaken dilapidation survey of the adjacent highway. Reason In the interest of highways safety and to comply with Policy SD3 of the Local Plan. |
| 8 | Prior to the development, hereby approved, coming into use details of the refuse and waste arrangements and storage shall be submitted to and agreed in writing with the Local Planning Authority. The details approved shall be implemented prior to the use commencing and retained for the lifetime of the development. REASON: To ensure a satisfactory form of development in accordance with policy SD4 of the Redcar and Cleveland Local Plan. |
| 9 | Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated. |
| 10 | Informative Note: At no point shall the adopted highway be blocked up without the prior consent of the Councils Engineering team who can be contacted on 01287 612536. |
| 11 | As discussed during the application this proposal does not provide for any works to the shop front or windows (boyond those windows indicated for infilling). Should any works be required express permission may be required and you are advised to contact hte Local Planning Authority for advise. Likewise any advertisement for the hotel/ restaurant may require Advertisement Consent. |
