| 3 | Development shall not commence until a detailed scheme for the disposal of surface water from the development hereby approved has been submitted to and approved in writing by the Local Planning Authority in consultation with Northumbrian Water and the Lead Local Flood Authority. The applicant shall provide cctv of the sewer to ensure the additional flows will not increase flood risk to the vicinity. | 4 | No development must commence until a Construction Management Plan has been submitted to and approved in writing by the Local Planning Authority. Construction of the permitted development must be undertaken in accordance with the approved plan. The Plan must include, but not be limited, to arrangements for the following in respect of each phase of the works: 1. Details of any temporary construction access to the site including measures for removal following completion of construction works; 2. Wheel washing facilities on site to ensure that mud and debris is not spread onto the adjacent public highway; 3. The parking of contractors’ site operatives and visitor’s vehicles; 4. Areas for storage of plant and materials used in constructing the development clear of the highway; 5. Details of site working hours; 6. Contact details for the responsible person (site manager/office) who can be contacted in the event of any issue. REASON: In the interest of public safety and amenity . REASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site as it relates to site preparation. |
| 5 | Development shall not commence until eDNA samples of the site are carried out and analysed for the presence of Great Crested Newts. Should the eDNA analysis be positive, follow up survey work will be required to determine the population size. The survey works shall be submitted to and approved by the Local Planning Authority. Should great created newts be present on the site a licence from Natural England will be required. A copy of the licence shall be submitted to the Local Planning Authority and the development shall be carried out in accordance with the details of the licence. REASONS: To protect a European protected species in accordance with Local Plan Policy N4. REASON FOR PRE-COMMENCEMENT: The information is required prior to any construction to avoid disturbance/destruction of a protected species or their habitat. |
| 6 | The development shall not be occupied until a Management & Maintenance Plan for the surface water drainage scheme has been submitted to and approved by the Local planning Authority; the plan shall include details of the following; (i) A plan clearly identifying the sections of surface water system that are to be adopted (ii) Arrangements for the short and long term maintenance of the SuDS elements of the surface water system REASON: To ensure that the surface water drainage infrastructure is maintained to minimise the risk flooding in the locality. |
| 7 | Notwithstanding the indicative ventilation layout details submitted on the 21/02/2023, a detailed scheme for ventilation shall be submitted to and approved in writing by the Local Planning Authority prior to any development above damp proof course. The scheme should ensure all internal inlet air drawn into the health centre is clean. REASON: To ensure users of the building are not at risk from smoke and products of combustion from the adjacent fire station training facility in accordance with the aims of Local Plan Policy SD4. |
| 8 | Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 9 | Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 10 | Notwithstanding the submitted Proposed landscaping strategy plan received on the 21/02/2023. Prior to (occupation of the building hereby approved) a landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority. The details shall include size, type and species and a programme of work. The development shall be completed in accordance with the approved details. REASON: To ensure that the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan. |
| 11 | All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality. |
| 12 | In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. Reason : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 13 | Prior to the development being brought into use, precise details showing the offsite highways works, including the amendments to the ghost island right turn and pedestrian and cycle crossing arrangements should be submitted and approved in writing by the Local Planning Authority. The works shall be completed in accordance with the approved details prior to the development opening. REASON: To ensure suitable access to the site in relation to highways safety in accordance with policy SD4 of the Local Plan. |
| 14 | Notwithstanding the details contained within the Interim Travel Plan received by the Local Planning Authority on 21/02/23 an updated travel plan shall be submitted to and agreed in writing with the Local Planning Authority prior to the development opening. The development shall then be implemented in accordance with the approved travel plan unless first agreed in writing with the Local Planning Authority. REASON: To ensure that the development does not have an adverse impact on the highway network in accordance with policy SD4 of the Redcar and Cleveland Local Plan. |
| 15 | Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary. |
| 16 | Applicants are reminded that in addition to securing planning permission other permissions may be required from Redcar and Cleveland Borough Council as Local Highway Authority. These additional permissions can include, but are not limited to: Agreements under Sections 278, 38, and 184 of the Highways Act 1980; Section 38 of the Commons Act 2006, permissions 3 through New Roads and Streetworks Act 1991 and Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 (as amended and including all instruments, orders, plans, regulations and directions).
