| 3 | (a) No development shall take place until a written scheme of investigation (WSI) for archaeological work has been submitted to and approved in writing by the local planning authority. The WSI shall as a minimum make provision for: - Before development commences, comprehensive evaluation by means of trial-trenching of all anomalies of suggested likely or possible archaeological significance detected by the geophysical survey conducted and reported on in the document ‘Tees Solar Farm, North Yorkshire: Archaeological Geophysical Survey’ (AOC Project No: 40298), Dated October 2022 - In accordance with the results of the evaluation and/or the geophysical survey, and before development commences, the strip, map and record excavation (‘SMR’) of all remains, features, structures, finds and/or deposits likely to be of more than low archaeological significance (provided that the WSI may make provision for the release of discrete areas of the development site for construction when the SMR is agreed by the local planning authority to have been completed in such areas); - An archaeological watching brief of all ground disturbance extending 300mm or more below ground level during construction groundworks in areas which the evaluation indicates are likely to contain archaeological remains, features, structures, finds and/or deposits of low (but not negligible) archaeological significance; - Protection during development, followed by consolidation and preservation of any very high value archaeological remains revealed by the evaluation and/or an SMR exercise and required to be left in situ; - a general programme of works and monitoring arrangements, including reasonable notification to the local planning authority of commencement of works; - details of staff involvement in carrying out the work (including specialists), and their qualifications and responsibilities; - the timetable for completing the post-evaluation report and (where applicable) the SMR and the post excavation assessment (‘PXA’). (b) Provision for the analysis, archiving and publication of the results of the SMR and watching briefs (including where relevant an amended PXA) shall be secured to the satisfaction of the local planning authority by the developer before the development is brought into use. (c) The development shall not without the prior written approval of the local planning authority be carried out otherwise than in accordance with the approved WSI, and (where relevant) the preservation of remains in-situ as provided for in the WSI (or as otherwise agreed at any time in writing by the local planning authority). REASON: The site is likely to contain remains of archaeological significance, some of which may merit preservation by record or in situ. |
| 4 | Notwithstanding the submitted information contained within the Landscape and Visual Appraisal received on the 03/01/2023, no development shall commence until, a detailed landscaping scheme shall be submitted to and approved in writing by the Local Planning Authority. The landscape scheme shall include the following: a. Any trees, hedges and shrubs scheduled for retention, including method of protection in accordance in BS.5837:2010. b. Details soft landscaping including planting species, sizes, layout, densities, numbers. c. Details of planting procedures and/or specification. d. Finished topsoil levels and depths. e. Details of temporary topsoil and subsoil storage provision. f. The timeframe for implementation of the landscaping scheme. g. The establishment maintenance regime, including the replacement of vegetation which die, fail to flourish within a period of 5 years from planting. The approved landscaping scheme shall thereafter be undertaken in accordance with the approved details and timeframes. REASON: In order to provide landscape enhancement and screening for the development in accordance with Redcar and Cleveland Local Plan Policy SD4 and N1. Reason for pre-commencement: In order to ensure landscaping is agreed and takes place early in the development. |
| 5 | Notwithstanding the submitted information contained within the ‘Outline Construction Management Plan received on 03/01/2023, no development shall commence until a detailed Construction Management Plan shall be submitted to and approved in writing by the Local Planning Authority. The approved Statement shall be adhered to throughout the construction period. The Statement shall provide the following; i) The parking of vehicles for site operatives and visitors; ii) Loading and unloading of plant and materials; iii) Storage of plant and materials used in constructing the development; iv) The erection and maintenance of security hoarding including decorative displays; v) Wheel washing facilities; vi) Measures to control the emission of noise dust and vibration during the construction period. vii) A scheme for recycling/disposing of waste resulting from demolition and construction works. REASON: To protect the amenity of nearby residents and commercial business and in the interests of highway safety on accordance with Local Plan Policy SD4. |
| 6 | In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 7 | The supplied Mitigation and Enhancement measures as detailed within Chapter 4.3.1 of the Ecological Impact Assessment received by the Local Planning Authority on 03/01/2023 shall be implemented in accordance with the Ecological impact Assessment. Any planting shall be carried out in the first tree planting season following the substantial completion of the development. Any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. REASON: In the interests of protecting the rural landscape and ecological with Local Plan Policy SD4, N1 and N4. |
| 8 | The supplied Landscape and Ecological Enhancements and management prescriptions as detailed within Chapter 3 of the Landscape and Biodiversity Management Plan received by the Local Planning Authority on 03/01/2023 shall be implemented in accordance with the Landscape and Biodiversity Management Plan Any planting shall be carried out in the first tree planting season following the substantial completion of the development. Any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. REASON: In the interests of protecting the rural landscape and ecological with Local Plan Policy SD4, N1 and N4. |
| 9 | Notwithstanding details contain with the approved plans relating to the position, number and size of CCTV cameras, prior to their use a detailed CCTV camera scheme is submitted to and approved in writing by the Local Planning Authority. The approved CCTV scheme shall thereafter be undertaken and retained in accordance with the approved details. REASON In the interests of the rural landscape and character in accordance with Local Plan Policy SD3 and N1. |
| 10 | Prior to their use details of any external lighting shall be submitted to and approved in writing by the Local Planning Authority. The lighting shall be erected and maintained in accordance with the approved details. REASON: To confirm the final precise lighting proposals having regards to residential amenity and biodiversity having regards to Policy SD3 and N1 of the Redcar and Cleveland Local Plan. |
| 11 | The permission hereby granted is for the development to be retained for a period of not more than 40 years from the date when electricity is first exported to the electricity grid (First Export Date) or in the event that electricity is not exported to the electricity grid from the date that works first commenced on site. Written confirmation of the First Export Date will be submitted in writing to the local planning authority within one month of the First Export Date. REASON: In the interest of the open character of the rural surroundings in accordance with Redcar and Cleveland Local Plan Policy. |
| 12 | Prior to the end of the 40-year period referred to in condition 11, a scheme for the restoration of the site shall be submitted for approval in writing to the local planning authority. Within 12 months of the scheme being approved, the solar panels shall be decommissioned and they and all related above and below ground structures shall be removed from the site, in accordance with the approved scheme for restoration, and the land shall be returned to agricultural use. REASON: In the interests of the rural landscape and character in accordance with Local Plan Policy SD3 and N1. |
| 13 | If any of the individual solar panels hereby permitted ceases to export electricity to the grid for a continuous period of 12 months, then a scheme of restoration shall be submitted to the Local Planning Authority for its written approval for the removal of the solar panel(s) and associated equipment and the restoration of (that part of) the site to agricultural use. The approved scheme of restoration shall be fully implemented in accordance with the approved scheme within 6 months of the date of its written approval by the Local Planning Authority. REASON: In the interests of the rural landscape and character in accordance with Local Plan Policy SD3 and N1. |
| 14 | Informative Note: The high pressure gas pipeline(s) in the vicinity of the proposed development is / are registered as a “Major Accident Hazard Pipeline (s)” and as such are subject to the HSE’s Land Use Planning advice methodology, along with the Pipelines Safety Regulations 1996. |
