# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: - Location plan received by the Local Planning Authority on 19/08/2022 - Proposed elevations of house - AMENDED 21 12 2022 received by the Local Planning Authority on 21/12/2022 - Proposed first floor plan of house received by the Local Planning Authority on 01/11/2022 - Proposed section of house received by the Local Planning Authority on 05/10/2022 - Proposed elevations of art studio - AMENDED 06 06 2023 received by the Local Planning Authority on 06/06/2023 - Proposed art studio floor plan - AMENDED 06 06 2023 received by the Local Planning Authority on 06/06/2023 REASON: To accord with the terms of the planning application.
3 The art studio hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as The Conifers. REASON: To accord with Local Plan Policy SD3 because the site is outside of development limits.
4 Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
5 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan.
6 Prior to the development being brought into permitted end use, the developer must either submit evidence that the building was built post 2000 or carry out an intrusive pre-demolition asbestos survey in accordance with HSG264 and provide a mitigation plan to reduce risks to potential workers, neighbours and other offsite receptors. REASON: To ensure that risks from asbestos to the future users of the land and neighbouring land are minimised, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
7 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. Reason : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors
8 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
9 Informative Note: The Public Right of Way shall remain available throughout the duration the development and continues to be accessible once the construction works have been completed.
