# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan, Drawing No. 001, received by the Local Planning Authority on 09.08.2022, Block Plan, Drawing No. 002, received by the Local Planning Authority on 09.08.2022, Proposed Plans & Elevations, Drawing No. 004, received by the Local Planning Authority on 09.08.2022. REASON: To accord with the terms of the planning application.
3 The external elevations of the extension hereby approved shall be built in the materials stated in the planning application hereby approved and shall complement in type, style and colour the external elevations of the existing dwelling. REASON: To ensure that the appearance of the development matches the existing property and would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
4 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority . If no contamination is found, following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours, and other offsite receptors.
5 The applicant is advised that the property is located in a Smoke Control Area and it is an offence under the Clean Air Act 1993 for smoke to be emitted from a chimney in a Smoke Control Area unless authorised fuels are being burnt or the appliance is exempt. In a smoke control area only certain authorised fuels, or any of the following ‘smokeless’ fuels, can be burnt unless it is burnt in an exempt appliance: • anthracite • semi-anthracite • gas • low volatile steam coal Wood is not classed as an authorised fuel. Therefore if the applicant wishes to install a solid fuel or wood burning appliance the appliance must be classified as an exempt appliance made in Regulations under the Clean Air Act 1993. In the event that the appliance is not classed as exempt then only authorised fuels should be used as stated above. 6 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
7 Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
