# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan received by the Local Planning Authority on 08.08.2022 Proposed site layout plan (ref DWG 05)received by the Local Planning Authority on 09.08.2022 Proposed Elevations (ref DWG 03)received by the Local Planning Authority on 09.08.2022 Proposed Plans (ref DWG 02)received by the Local Planning Authority on 09.08.2022 Proposed Car port (ref DWG 04)received by the Local Planning Authority on 10.08.2022 REASON: To accord with the terms of the planning application.
3 Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
4 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
5 Informative Note: At no point shall the adopted highway be blocked up without the prior consent of the Councils Engineering team who can be contacted on 01287 612536.
6 The applicant is advised that the property is located in a Smoke Control Area and it is an offence under the Clean Air Act 1993 for smoke to be emitted from a chimney in a Smoke Control Area unless authorised fuels are being burnt or the appliance is exempt. In a smoke control area only certain authorised fuels, or any of the following ‘smokeless’ fuels, can be burnt unless it is burnt in an exempt appliance: • anthracite • semi-anthracite • gas • low volatile steam coal Wood is not classed as an authorised fuel Therefore if the applicant wishes to install a solid fuel or wood burning appliance the appliance must be classified as an exempt appliance made in Regulations under the Clean Air Act 1993. In the event that the appliance is not classed as exempt then only authorised fuels should be used as stated above. The applicant should also be advised that from 01/05/2022 amendments to Smoke Control Area (SCA) enforcement under the Environment Act 2021 came into effect. The changes are as follows: • The Local Authority will be able to issue financial penalties to those emitting substantial amounts of smoke from their chimney in a SCA. The financial penalties range from a minimum of £175 to a maximum of £300. • The Local Authority will be able to issue an abatement notice for smoke emissions that are harmful to human health or a nuisance in a SCA.
