1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: - Location plan received by the Local Planning Authority on 01/08/2022 - Proposed site plan received by the Local Planning Authority on 01/08/2022 - Proposed elevations AMENDED 26 09 2022 (Dwg no: 2133-LAL-00-ZZ-DR-A-00-600 Rev P1) received by the Local Planning Authority on 26/09/2022 - Proposed plans AMENDED 21 10 2022 ((Dwg no:2133-LAL-00-ZZ-DR-A-00-500 Rev P1)) received by the Local Planning Authority on 21/10/2022 - Proposed roof plan AMENDED 26 09 2022 (Dwg no: 2133-LAL-00-ZZ-DR-A-00-501 Rev P1) received by the Local Planning Authority on 26/09/2022 - Proposed building sections AMENDED 26 09 2022 (Dwg no: 2133-LAL-00-ZZ-DR-A-00-700 Rev P1) received by the Local Planning Authority on 26/09/2022 - Existing and proposed site sections received by the Local Planning Authority on 01/08/2022 REASON: To accord with the terms of the planning application.
3 Prior to installation, full details and/or samples of bricks, roof tiles/slates, rainwater gutters and pipes, windows and doors to be used in the external elevations and for the roof, shall be submitted to and approved in writing by the local planning authority. The development shall be completed in accordance with the approved details. REASON: To safeguard the special character of the conservation area and the settings of adjacent listed buildings as required by policies HE1 and HE2 of the adopted Local Plan.
4 The galvanized balcony metalwork shall be finished in a colour to be agreed with the Local Planning Authority prior to installation. REASON: To safeguard the special character of the conservation area and the settings of adjacent listed buildings as required by policies HE1 and HE2 of the adopted Local Plan.
5 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan.
6 The development hereby approval shall be completed in accordance with the proposed ground levels over the site together with finished floor levels and maximum building heights shown on the Proposed building sections AMENDED 26 09 2022 drawing submitted to the Local Planning Authority on 26/09/2022 and the Existing and proposed site sections drawing submitted to the Local Planning Authority on 01/08/2022. REASON: To ensure a satisfactory relationship between existing and proposed buildings in accordance with policy SD4 of the Local Plan.
7 Prior to the development being brought into permitted end use, the developer must either submit evidence that the building was built post 2000 or carry out demolition asbestos survey in accordance with HSG264 and provide a mitigation plan to reduce risks to potential workers, neighbours and other offsite receptors. REASON: To ensure that risks from asbestos to the future users of the land and neighbouring land are minimised, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
8 Prior to commencement of construction, a CEMP shall be submitted to and approved in writing by the Local Planning Authority. The approved Statement shall be adhered to throughout the construction period. The Statement shall provide the following; i) The parking of vehicles for site operatives and visitors; ii) Loading and unloading of plant and materials; iii) Storage of plant and materials used in constructing the development; iv) The erection and maintenance of security hoarding including decorative displays; v) Wheel washing facilities; vi) Methods of demolition; vii) Measures to control the emission of noise dust and vibration during the construction period. viii) A scheme for recycling/disposing of waste resulting from demolition and construction works. REASON: To protect the amenity of nearby residents and in the interests of highway safety.
9 Prior to the development being brought into end use, a detailed acoustic report shall be submitted to and approved by the Local Planning Authority. The detailed acoustic report shall be carried out by a competent person and shall detail the existing noise climate at the development site. The following documents; BS 8233, WHO Guidelines on community noise and ProPG: Planning and Noise specifically address these issues. The aim of the report will be to establish whether sound attenuation measures are required to protect future residents from the transferral of sound from commercial premises (including extraction systems) and from road traffic noise. In the event that the acoustic report finds that the following noise levels would be exceeded, a noise insulation scheme shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be permanently retained whilst the permitted use continues. REASON: In the interest of neighbour amenity.
10 Prior to the development being brought into end use a scheme which specifies the provisions to be made for the control of odour emanating from commercial premises shall be submitted to and approved in writing by the Local Planning Authority. REASON: In the interest of neighbour amenity.
11 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
12 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
