# Condition Details
The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan - received by the Local Planning Authority on 07/10/2021 Site and car parking plan - received by the Local Planning Authority on 11/10/2021 Proposed plan and roof plan - received by the Local Planning Authority on 07/10/2021 Proposed elevations and section plan - received by the Local Planning Authority on 07/10/2021 REASON: To accord with the terms of the planning application.
The external elevations of the extension hereby approved shall be built in materials to match in type, style and colour the external elevations of the existing dwelling. REASON: To ensure that the appearance of the development matches the existing property and would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
The attention of the applicant be drawn to the risk of Radon on the site. A desk study including a review of the BGS 2007 GIS data layer indicates that the proposed development site is in a Class 2 Radon affected area where there is the potential for between 1 and 3% of existing and future properties within the area to be above the action level of 200 Bqm-3. Public Health England advises that a Radon gas test should be carried out in all properties where more than 1% of homes are estimated to be above the action level (200 Bqm-3) within radon affected areas. Public Health England also suggest that where less than 1% of homes are above the action level then consideration also be given to carrying out radon gas tests and fitting radon prevention measures to new buildings. BRE 211 (2015) advises that areas with an increased radon potential can be sufficiently protected by a well-designed and fitted gas barrier membrane of 300 micron (1200 gauge) which is generally equivalent to gas characteristic situation 2 referenced in CIRIA C655.
The applicant is advised that the property is located in a Smoke Control Area and it is an offence under the Clean Air Act 1993 for smoke to be emitted from a chimney in a Smoke Control Area unless authorised fuels are being burnt or the appliance is exempt. In a smoke control area only certain authorised fuels, or any of the following ‘smokeless’ fuels, can be burnt unless it is burnt in an exempt appliance: • anthracite • semi-anthracite • gas • low volatile steam coal Wood is not classed as an authorised fuel. Therefore, if the applicant wishes to install a solid fuel or wood burning appliance the appliance must be classified as an exempt appliance made in Regulations under the Clean Air Act 1993. In the event that the appliance is not classed as exempt then only authorised fuels should be used as stated above.
Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
