# Condition Details
1 The application proposes the development of a mineral recycling facility which includes the erection of a 2m high acoustic fence located on the top of an existing bund. The area of the bund and proposed fence is land which is identified in the Redcar and Cleveland Local Plan 2018 as an area allocated for a proposed extension to the adjoining 'Haven' site. The Haven site is presently used for the provision of accommodation and facilities for the gypsy and traveller community of the Borough. The development of the application site, and the bund in particular, will prejudice the delivery of the proposed extension and therefore impact on the ability of the Local Planning Authority to meet the future housing needs of the gypsy and traveller community contrary to policy SD4(a) and H7.
2 The application proposes the development of a mineral recycling facility on land which adjoins an area of land known as the Haven; the Haven is a site which provides permanent facilities and residential accommodation for the Gypsy and Traveller community of the Borough. The access to the proposed development is located to the immediate south of the Haven and would be the only access to the development site. The nature of the development proposed would result in the use of the access road by HGV vehicles on a daily basis and the Local Planning Authority considers this will give rise to condition prejudicial to the residential amenity of occupiers of the Haven site by reason of noise and general disturbance. The development is therefore contrary to policy SD4(b) of the Redcar and Cleveland Local Plan 2018.
3 Statement of Co-operative Working: The Local Planning Authority notes that additional information and clarification has been submitted with the application to respond to the matters in the previous appeal decision, and that mechanisms to mitigate the impact of the development have been suggested. However, in the opinion of the Local planning Authority , the development will prejudice the delivery of the allocation identified under policy H7 of the Development Plan and result in an adverse impact on the adjoining residential site by reason of daily HGV movements and the Planning Authority has not been able to adopt a negotiating position in respect of these matters.
