# Condition Details
1 The residential accommodation within the amenity building the subject of this application, shall be used and occupied only on an incidental basis and for purposes ancillary to the use of the site for the keeping of horses and related equestrian activity. The building shall not, at any time, be occupied or otherwise used a person's sole place of residence and shall not at any time be occupied on a permanent basis as a dwelling within use class Class 3 (Dwelling) of the Town and Country Planning Use Classes Order 2020 (as amended) The building shall at all times be maintained within the same planning unit identified on the application. REASON; The site lies outside the development limits identified in the adopted development plan (Redcar and Cleveland Local Plan May 2018) where the development of new housing is subject to a policy of development restraint and where new dwellings require particular justification. The use of the site for small scale equestrian use does not provide an adequate planning policy justification for the development of living accommodation and so the condition is necessary to ensure the accommodation provided within the amenity building is used for purposes ancillary to the use of the site for the keeping of horses and not used or otherwise occupied as a permanent dwelling within Class C3 to comply with the terms of the application and prevent a breach of a development plan policy.
2 The planning permission hereby granted relates to the submitted plan (Drwg no RC/21/002/002) received by the Local Planning Authority on 20 July 2021 which shows the internal arrangement of the building as providing a single bedroom, lounge area, kitchen and shower room with storage. The development hereby approved shall be retained in the manner and layout shown on the approved plan and there shall be no further internal or external alterations to the building to alter the internal layout of the building. REASON; The site lies outside the development limits identified in the adopted development plan (Redcar and Cleveland Local Plan May 2018) where the development of new housing is subject to a policy of development restraint and where new dwellings require particular justification. The use of the site for small scale equestrian use does not provide an adequate planning policy justification for the development of living accommodation and so the condition is necessary to ensure the accommodation provided within the amenity building is used for purposes ancillary to the use of the site for the keeping of horses and that no further works are carried out that would incrementally contribute to the creation of a new dwelling.
3 The storage area shown on the submitted and approved plan (Drwg no RC/21/002/002) received by the Local Planning Authority on 20 July 2021 shall be used for purposes ancillary to the use of the site for equestrian activity , it shall not, at any time, be used as an extension to the ancillary living accommodation provided by the amenity building. REASON; The site lies outside the development limits identified in the adopted development plan (Redcar and Cleveland Local Plan May 2018) where the development of new housing is subject to a policy of development restraint and where new dwellings require particular justification. The use of the site for small scale equestrian use does not provide an adequate planning policy justification for the development of living accommodation and so the condition is necessary to comply with the terms of the application and to ensure the storage area provided within the amenity building is used for purposes ancillary to the use of the site for the keeping of horses and that no further works are carried out that would incrementally contribute to the creation of additional accommodation or the creation new dwelling.
4 Notwithstanding the provisions of The Town and Country Planning (General Permitted Development ) Order 2015 (as amended) or any subsequent order re-enacting that Order, no works shall be carried on any part of the site, and most particularly around the amenity building approved, to develop or physically denote private garden space or the creation of a domestic curtilage. REASON; The site lies outside the development limits identified in the adopted development plan (Redcar and Cleveland Local Plan May 2018) and in open countryside. The condition is necessary to ensure that the amenity building retains its external appearance as being ancillary to the use of the site and that the character and appearance of the site and surrounding countryside is protected from additional development of a domestic nature which may further erode the character and appearance of the countryside.
5 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
