# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan, Scale 1:1250, received by the Local Planning Authority on 04/02/2021 Site Plan, received by the Local Planning Authority on 04/02/2021 Proposed Site Block Plan, Plans and Elevations, DRAWING No. 20/093/01, received by the Local Planning Authority on 04/02/2021 REASON: To accord with the terms of the planning application.
3 Prior to any development above damp proof course details of the external materials to be used in the carrying out of this permission (including samples) shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
4 Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
5 Prior to the development hereby approved coming into use a crossing shall be provided on Stanghow Road to link the footpath adjacent to Meadowdale Court to the retail store. The scheme shall be installed on site in accordance with details which have first been submitted to and approved in writing with the Local Planning Authority and shall remain for the lifetime of the development. REASON: In the interests of highways safety in accordance with policy SD4 of the Redcar and Cleveland Local Plan.
6 The proposed building hereby approved shall be used as retail convenience store (Class E(a)) only and no other use falling within Class E of the planning Use Class Order without the express consent of the Local Planning Authority. REASON: To ensure the Local Authority retains control over future uses of the site in the interest of highways safety, neighbour amenity and the character and appearance of the area in accordance with policies SD4, ED1 and ED6 of the Redcar and Cleveland Local Plan.
7 The premises shall not be open to customers outside the following hours:- 07:00 – 20:00 Mondays to Saturdays 10:00 – 20:00 Sundays and Bank Holidays REASON: To ensure the development would not cause any issues in terms of noise and disturbance in the interest of residential amenity in accordance with policy SD4 of the Local Plan.
8 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
9 Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
10 Informative Note: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
11 Informative Note: At no point shall the adopted highway be blocked up with out the prior consent of the Councils Engineering team who can be contacted on 01287 612536.
