| 3 | The development hereby permitted shall be carried out in strict accordance with mitigation measures included within the Flood Risk Assessment (FRA) received by the Local Authority on 29th May 2020. The mitigation measures listed below identified within the FRA must be adhered to and retained during the lifetime of the development: - Flood alarm system - Flood gate/flood door installed - Suitable airbrick to stop water passage - Raised electrical equipment REASON: To protect occupiers of the units and residential accommodation from flooding in accordance with Local Plan Policy SD7. |
| 4 | Prior to the development being brought into end use, a detailed acoustic report shall be submitted to and approved by the Local Planning Authority. The detailed acoustic report shall be carried out by a competent person, and shall detail the existing noise climate at the development site. The following documents; Noise Policy statement for England, BS 8233, WHO Guidelines on community noise and ProPG: Planning and Noise specifically address these issues. The aim of the report will be to establish whether sound attenuation measures are required to protect future residents from the transferal of sound from commercial premises and from road traffic noise. In the event that the acoustic report finds that the following noise levels would exceed the LOAEL – Lowest Observed Adverse Effect Level, a noise insulation scheme shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be permanently retained whilst the permitted use continues. REASON: In the interest of neighbour amenity in accordance with Local Plan Policy SD4. |
| 5 | Notwithstanding the details submitted as part of the application. Prior to installation of the equipment for ventilation and filtration to suppress and disperse any fumes and/or smell created from the cooking operations on the premises (including details of noise attenuation), a scheme of works shall first be submitted to and approved in writing by the Local Planning Authority. The development shall not be brought into end use until the approved ventilation equipment has been installed in accordance with manufacturer’s instructions and approved in writing by the Local Planning Authority. All equipment installed as part of the approved scheme shall thereafter be retained, operated and maintained in accordance with that approval. REASON: In the interests of the amenity of the area in accordance with Local Plan Policy SD4. |
| 6 | The cafe/public house uses hereby approved shall not commence until a litter management plan has been submitted to and approved in writing by the Local Planning Authority. The management plan shall be implemented in accordance with the approved details and retained at all times. REASON: To ensure that any waste from the site is managed correctly and does not cause a detrimental impact to the street scene in accordance wit policy SD4 of the Local Plan. |
| 7 | The working hours for all construction and demolition activities on this site are limited to between 08:00 and 18:00 Mondays to Fridays and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holidays. REASON: In the interest of neighbour amenity. |
| 8 | Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated. |
