The occupation of the site hereby permitted shall be restricted to the following and their resident dependants and no other person (Mr Robert Foster). When the land cease to be occupied by the person(s) named, the use shall cease and the all caravans, structures, materials and equipment brought onto the land in connection with the residential use shall be removed and the site restored to employment use within 6 months of the date of the cessation of the use, in accordance with a scheme to be submitted and agreed with the Local Planning Authority, unless a new planning application has been made and granted to a qualifying person. Reason - The development is one which it is considered conflicts with the development plan and which the Local Planning Authority would not normally approve, the grant of permission as a departure from policy recognises the personal circumstances of the applicant in this case.
The development hereby permitted shall be carried out in accordance with the following approved plans: RC/19/0599/FF received by the Local Planning Authority on 23.9.2019 RC/19/005/004 received by the Local Planning Authority on 23.9.2019 REASON: To accord with the terms of the planning application
The remediation scheme specified in the SI report dated 15 August 2017 shall be carried out in accordance with its terms unless otherwise agreed in writing by the Local Planning Authority. Remediation shall be completed within 6 months of this planning approval, or in such extended time as may be agreed in writing with the Local Planning Authority. The Local Planning Authority shall be given two weeks written notification of commencement of the remediation scheme works. Following completion of the measures identified in the approved remediation scheme, a Validation Report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval in writing of the Local Planning Authority. REASON: To ensure that risks from land contamination to the future residential users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems and to ensure that the development can be carried out safely without unacceptable risks to workers, potential occupiers, neighbours and other offsite receptors.
In the event that contamination is found at any time when carrying out the approved development that was not previously identified, it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where remediation is necessary, a remediation scheme shall be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a Verification Report shall be prepared, which is subject to the approval in writing of the Local Planning Authority. Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development REASON: To ensure that risks from land contamination to the future residential users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems and to ensure that the development can be carried out safely without unacceptable risks to workers, potential occupiers, neighbours and other offsite receptors.
Prior to the construction of the raised landscaping beds indicated on the submitted plan (Drwg No RC/19/005/003) a landscaping scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include the specification of the raised bed structures, planting regime, size, type and species of planting and a programme of maintenance. The approved landscaping scheme shall be implemented in the next available planting season. Reason; To confirm the details of the proposed amenity area to serve the static residential caravan in the interests of the maximising the level of amenity and well-being of the occupier.
Prior to the implementation of the permission granted a scheme for surface water drainage to serve the site shall be submitted and approved by the Local Planning Authority in writing and the approved scheme of drainage shall be implemented concurrently with the carrying out of the remediation scheme. Reason; To ensure the site benefits from the necessary infrastructure for the disposal of surface water.
Upon the implementation of the permission hereby granted the authorised use of the site shall be for the residential occupation of the mobile home within class C3 of the Use Classes Order with ancillary domestic storage, amenity space and on-site parking and no trade or business shall be conducted from the site at any time unless the residential occupation of the site has ceased and the site reverts to its previous employment use in accordance with the terms of condition (1) above. Reason; The application approved has addressed one of the primary concerns of the Local Planning Authority on the quality of the residential environment by removing the immediately adjoining employment related use. The condition limiting the use of the site to residential use is required to maintain the level of amenity provided by the amended scheme.
Although considered contrary to policy and the subject of two previous refusal of planning permission, the Local Planning Authority considers that the amendments made to the current application address the primary concerns of the Council in respect of the quality of the living environment and through discussions the Council has been pro-active in agreeing planning conditions with the applicant's agent to address the remaining planning matters.
