# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: - Existing site plans received by the Local Planning Authority on 17th September 2019 - Proposed site plans received by the Local Planning Authority on 12th November 2019 - Proposed plans and elevations received by the Local Planning Authority on 12th November 2019 REASON: To accord with the terms of the planning application.
3 Prior to the commencement of development plans showing the existing and proposed ground levels over the site together with finished floor levels and maximum building heights shall be submitted to and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure a satisfactory relationship between existing and proposed buildings in accordance with policy SD4 of the Local Plan. REASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site as construction activity and site preparation can change existing levels resulting in increased ground levels which the authority needs to consider.
4 Prior to the commencement of development, plans showing details of the foul and surface water drainage shall be submitted to and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure the development is supported by a suitable foul water dispersal scheme and a suitably designed surface water disposal infrastructure scheme to minimise the risk flooding in the locality. REASON FOR PRE-COMMENCEMENT: The information is required prior to any works commencing on site it relates to drainage details which are often the first works on site and relate to site preparation.
5 The development shall be completed in accordance with the below materials: - Forterra Farmstead Antique bricks - Dark Portland semi dry cast stone - Sandtoft Cassius roof tiles REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
6 Prior to the construction of the final surface treatment, for any hard surfaced areas, details of the materials to be used shall have first been submitted to, and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details. REASON: To ensure that the appearance of the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
7 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan.
8 Prior to construction of foundations on site, details shall be submitted to and agreed in writing by the Local Planning Authority, of proposals to provide contractors car parking and material storage within the site. The details approved shall be retained for use until completion of the development unless first agreed in writing with the Local Planning Authority. REASON: To ensure that any parking and storage is provided within the site in the interest of highways safety and in accordance with policy SD4 of the Redcar and Cleveland Local Plan.
9 Prior to any development above damp proof course, a scheme of noise insulation measures for the residential accommodation shall be submitted and approved by the local planning authority . The noise insulation measures shall be designed to achieve noise insulation to a standard that nuisance will not be caused to the occupiers of residential accommodation from the adjacent railway line. The measures shall be retained in perpetuity. Reason: In the interest of the amenity of the proposed development in accordance with Policy SD3 of the Redcar and Cleveland Local Plan.
10 Prior to the first occupation of the development, hereby approved, a 1.8m high screen shall be installed on the north east facing elevation of the proposed balcony in accordance with a scheme that has first been submitted to and agreed in writing with the Local Planning Authority. The screen shall thereafter be maintained unless the express consent of the Local Planning Authority is given. REASON: To protect the amenity of neighbouring properties on The Crescent in accordance with policy SD3 of the Redcar and Cleveland Local Plan.
11 Prior to any development above damp proof course, details of any external lighting shall be submitted to and agreed in writing by the local planning authority. The details shall include the location, colour and brightness. The external lighting shall thereafter be maintained unless the express consent of the Local Planning Authority is given. REASON: To ensure external lighting does not dazzle or confuse train drivers on the adjacent railway.
12 Prior to the first occupation of the development, hereby approved, boundary walls and fences shall have been erected in accordance with a scheme that has first been submitted to and agreed in writing with the Local Planning Authority. The boundary walls and fences shall thereafter be maintained unless the express consent of the Local Planning Authority is given. REASON: To ensure that any boundary treatments would accord with policy SD4 of the Redcar and Cleveland Local Plan by respecting the character of the site and the surroundings and raising no significant adverse impact on neighbouring occupiers.
13 All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
14 Prior to occupation of the dwelling hereby approved a landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority. The details shall include size, type and species and a programme of work. The development shall be completed in accordance with the approved details. REASON: To ensure that the development would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
15 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. Following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. REASON: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors
16 Informative Note: At no point shall the adopted highway be blocked up with out the prior consent of the Councils Engineering team who can be contacted on 01287 612536.
17 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
