# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: - Location plan received by the Local Planning Authority on 13th September 2019 - Proposed elevations and views received by the Local Planning Authority on 11th December 2019 REASON: To accord with the terms of the planning application.
3 The business use hereby approved shall be carried out only by Ms Faye Simpson whilst she is a resident at the 41 Micklow Lane. REASON: To ensure the development complies with the aims of policy SD1 and SD4 of the Local Plan.
4 The premises shall be used for a mixed use as a single dwellinghouse and a business use comprising of the operation of a Canine Hydrotherapy Centre (sui generis use) and for no other purpose. The business use hereby approved shall operate solely within the existing garage and no part of the business shall operate within the main dwellinghouse. REASON: To ensure the development would not cause any issues in terms of noise and disturbance in the interest of residential amenity in accordance with policy SD4 of the Local Plan.
5 The business use hereby permitted shall not operate other than between the hours of 0900-1900 on Mondays to Saturdays. REASON: To ensure the development would not cause any issues in terms of noise and disturbance in the interest of residential amenity in accordance with policy SD4 of the Local Plan.
6 No more than 25 clients shall be treated at the property in any seven-day period, and a record of the numbers of persons treated in the operation of this use, and the date and time of their appointment, shall be kept and made available for inspection by the Local Planning Authority upon written request. REASON: To ensure the development would not cause any issues in terms of noise and disturbance in the interest of residential amenity in accordance with policy SD4 of the Local Plan.
7 Prior to the development being brought into end use a scheme which specifies the provisions to be made for the control of noise emanating from the site shall be submitted to and approved in writing by the Local Planning Authority before the use commences. The approved scheme shall be implemented prior to the use commencing and shall remain for the lifetime of the development. REASON: To ensure the development would not cause any issues in terms of noise and disturbance in the interest of residential amenity in accordance with policy SD4 of the Local Plan.
8 The external elevations of the extension(s) hereby approved shall be built in materials to match in type, style and colour the external elevations of the existing dwelling/building. REASON: To ensure that the appearance of the development matches the existing property and would respect the site and the surroundings in accordance with policy SD4 of the Local Plan.
9 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
