# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan received by the Local Planning Authority on 07/01/19 Proposed Plans (Drg No. 03 Rev A) received by the Local Planning Authority on 04/03/19 Proposed Elevations (Drg No. 04 Rev B) received by the Local Planning Authority on 04/03/19 REASON: To accord with the terms of the planning application.
3 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Public Holiday. REASON: To ensure that the any activity during the construction development would not have a significant adverse impact in relation to noise and disturbance in accordance with policy SD4 of the Local Plan.
4 The premises shall not be open to customers outside the following hours:- 08:00 to 23:00 Monday to Sunday REASON: To ensure the development would not cause any issues in terms of noise and disturbance in the interest of residential amenity in accordance with policy SD4 of the Local Plan.
5 Prior to the use hereby approved being brought into use a scheme for the effective control of fumes and odours from the premises shall be submitted to and agreed in writing by the Local Planning Authority. The scheme approved shall be implemented prior to the use commencing and thereafter retained at all times. REASON: In the interest of residential amenities of the area.
6 Prior to the use hereby approved being brought into use a scheme for the enclosure of any noise emitting plant and machinery, including details of any sound-insulating enclosure, mounting to reduce vibration and transmission of structural borne sound from the extract system, shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be completed prior to the use commencing and shall thereafter be retained. Before any other plant or machinery is used on the premises other than as provided in the approved scheme, a further scheme evidencing the same matters should be submitted to and approved by the Local Planning Authority and the approved scheme shall be completed before the development is first used. REASON: To protect the amenities of occupiers of nearby properties from excessive noise.
7 Prior to the use hereby approved being brought into use a scheme for the noise insulation between the proposed development and first floor residential accommodation shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be completed prior to the first occupation of the development and shall therefore be retained. REASON: To minimise the disturbance by noise of existing residential occupiers.
8 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
