3 For site B only: Details of the external materials to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
4 For Site B only:A landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of development. The details shall include size, type and species of plant including replacement hedge and tree planting, indicate the proposed layout and surfacing of all open areas and incorporate the mitigation outlined in both Phase 1 Habitat Surveys submitted to the Local Planning Authority on 15 March 2012. The approved scheme shall be adhered to. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
5 Site A and B: All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
6 For Site B only: Notwithstanding the boundary details submitted no dwelling shall be occupied until the boundary walls and fences (including acoustic screening) for that dwelling have been erected in accordance with a scheme that has first been agreed in writing with the Local Planning Authority. Thereafter they shall be maintained. REASON: In the interests of visual and residential amenity.
7 For Site A: For the proposed 14 no. affordable/social dwellings, 13 no. of which are required to be provided pursuant to the S106 and as identified in the submitted documentation, the mechanism for their delivery shall be agreed in writing with the Local Planning Authority. REASON: 13no. affordable dwellings are required to be provided pursuant to the S106 Agreement.
8 The site is crossed by two public rights of way including part of the Cleveland Way National Trail. The developer is advised to contact the Highway Authority with regard to proposed phasing of construction in order to minimise disruption to the use of the public rights of way.
9 Informative Note: At no point shall the adopted highway be blocked up with out the prior consent of the Councils Highways Maintenance section.
10 The applicant/developer is advised to contact Helen Oakes on 01287 612536 to make arrangements for the postal address for the development.
11 The Contaminated Land Officer recommends that the attention of the applicant be drawn to the risk of Radon on the site.
12 The S106 Agreement relates to the agreement associated with planning permission reference L/1992/1029/OO as modified by application reference R/2006/0542/PO.
13 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated.
