# Condition Details
The application proposes a new dwelling outside the identified development limits set out in the development plan, where a policy a development restraint applies. No evidence has been submitted to demonstrate the proposal meets with any of the policy exceptions set out in the NPPF and the development plan and that a departure from established policy is appropriate in this case. The proposal is therefore contrary to the National Planning Policy Framework and policies DP1 (Development Limits) and CS2 (Locational Strategy) of the Redcar and Cleveland Local Development Framework 2007.
The proposed dwelling, in view of the site’s location, is considered to be unsustainable development contrary to policy set out in the National Planning Policy Framework and policies CS1 (Securing a Better Quality of Life), CS2 (Locational Strategy),CS19 (Delivering Inclusive Communities), DP2 (Location of Development) and DP3 (Sustainable Design) of the Redcar and Cleveland Local Development Framework 2007 and contrary to the key policy objective of the NPPF to promote sustainable development.
The development proposed is considered to be a poor design and of limited design merit which will not contribute to a sense of place or make a positive contribution to appearance of the locality. The development is therefore considered contrary to policy CS20 (Promoting Good Design) and DP3 (Sustainable Design) of the Redcar and Cleveland Local Development Framework 2007and the policy guidance on design set out in the National Planning Policy Framework.
The proposed dwelling, due to the significant alterations proposed, (increase in ridge height, installation of new openings in all elevations and installation of a new first floor) would not comply with criteria d of policy DP14 (Conversion of Existing Buildings in the Countryside) and is contrary to this adopted policy within the Development Policies DPD.
The Local Planning Authority considers that the application as submitted did not meet with national and local policies and guidance. Since the development proposed is not acceptable, as a matter of principle, it has not been able to adopt a negotiating position on the application. An application for residential use on the site has previously been refused and dismissed at appeal, no additional justification has being provided within the current application.
