REASON: To reserve the rights of the Local Planning Authority with regard to these matters and required to be imposed pursuant to Sections 91 and 92 of the Planning & Compulsory Purchase Act 2004. |
The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last of the reserved matters to be approved, whichever is later. REASON: Required to be imposed pursuant to Sections 91 and 92 of the Planning & Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following approved plans: Site Plan 15591/1 received by the Local Planning Authority on 4 May 2016, Site Location Plan 15591/10 received by the Local Planning Authority on 11 May 2016 and Site Plan as Proposed SC 3 15591/4A received by the Local Planning Authority on 28 July 2016. REASON: To accord with the terms of the planning application.
The reserved matters submitted in accordance with Condition 1 above shall incorporate a scheme that shall be restricted to ground floor accommodation only in the form of bungalow development. REASON: In the interests of residential amenity.
The removal of the willows and walnut tree shall be carried out taking the following precautionary approach: The tree should be felled during the active bat season (April-October, inclusive), in order to minimise the risk of disturbing hibernating bats, if present; Before works commence contractors should be made aware of the potential for occasional bats to be roosting within the hollows and crevices; Soft felling should be undertaken to allow bats, if present, to fly out from the removed limbs before they are taken off Site; and In the event that a bat is found, or if significant evidence of bats is found (such as a pile of droppings which look like mouse droppings), works must stop immediately and a licensed bat ecologist should be contacted to decide on the most appropriate way forward. Natural England shall be contacted in this event; and it may be necessary to postpone all works until further survey for bats has been undertaken in order to have adequate survey information to apply for an EPSL from Natural England. REASON: In the interests of bat protection.
Any habitat removal or felling works undertaken on the scattered trees, shrubs and hedgerow featured on the Site should not be performed between March and August (inclusive) to avoid the main bird nesting bird season. In addition, the demolition of the old greenhouse structure on Site should take place outside of this nesting period. If Site clearance works are deemed necessary during the bird nesting period an experienced ecologist will be required to check the vegetation and greenhouse immediately prior to works commencing to confirm that no nesting birds will be affected by the proposed works. REASON: In the interests of the protection of nesting birds
Before any dwelling hereby approved is occupied two bat boxes (a 1FF and a 2F Schwegler bat box) shall be installed at the Site in accordance with details that have first been submitted and approved in writing by the Local Planning Authority. The details shall demonstrate that they will be installed to avoid a northerly aspect, ideally being situated directly south, at a minimum height of 3 m in proximity to a vegetated corridor, and avoiding directional lighting. The boxes shall thereafter be maintained. REASON: In the interests of the bat population.
Prior to the occupation of any of the dwellings six bird nest boxes (three suitable for small hole nesting birds such as blue tits and great tits, two open fronted boxes suitable for robins and wrens, and a terrace nest box suitable for house sparrows) shall have been installed in accordance with details that have first been submitted to and approved in writing by the Local Planning Authority. Apart from the terrace nest box, which should be installed under the eaves of a residential building or garage, they should be placed on suitable trees to be retained around the site. All boxes should be installed in a sheltered and undisturbed position at a height of at least 3 m, and avoiding a southerly aspect. The bird boxes shall thereafter be maintained. REASON: In the interests of biodiversity.
The reserved matters required by Condition 1 above shall include details of the boundary walls and fences for this site. The approved details shall have been erected prior to the first occupation of the scheme and shall thereafter be maintained. REASON: In the interests of visual and residential amenity.

REASON: To ensure the use of satisfactory materials. |
Development shall not begin until the developer has prepared a scheme of works to deal with dust from the site that adequately takes into account the impact of site preparation and construction works. The scheme required shall be submitted to and approved by the Local Planning Authority in writing prior to works commencing and the approved scheme shall be implemented in its entirety. REASON: To protect the amenities of the occupiers of nearby dwellings
Development shall not commence until a detailed scheme for the disposal of foul and surface water from the development hereby approved has been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall take place in accordance with the approved details. REASON: To prevent the increased risk of flooding from any sources.
The development hereby permitted shall not be occupied until details of the arrangements for the storage of refuse have been submitted to, and approved in writing by, the Local Planning Authority. The use of the refuse storage area agreed shall thereafter be retained at all times. REASON: To safeguard the amenity of the area.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 2015, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. | 20 | In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is to be submitted for approval in writing by the Local Planning Authority. The approved remediation scheme shall be adhered to in its entirety. REASON: In the interests of environmental protection
The Phase 1 Habitat Survey at Recommendation 3 regarding the presence of Horse Tail at this site states: This species was recorded in the east of the central and southern gardens. Whilst not listed as a Schedule 9 invasive species under the WCA (1981, as amended), this species spreads rapidly through rhizomes which can reach a depth of 2 m, making it particularly difficult to eradicate from soils. Therefore, in order to prevent further spread across the site, it is recommended that a treatment plan is put in place immediately.
The Phase 1 Habitat Survey advises that :The use of native plant species sourced from local nurseries is recommended in landscape proposals to enhance foraging opportunities for local birds and bats, by increasing the invertebrate diversity on-site. A species list of recommended trees and shrubs is given below: Beech Fagus sylvatica; Elder Sambucus nigra; Field maple Acer campestre; Silver birch Betula pendula; Rowan Sorbus aucuparia; Small-leaved lime Tilia cordata; Bird cherry Prunus padus; Blackthorn Prunus spinosa; Hazel Corylus avellana; Hawthorn Crataegus monogyna; Holly Ilex aquifolium; Honeysuckle Lonicera periclynemum; Wild privet Ligustrum vulgare; Walnut Juglans regia; and Guelder-rose Viburnum opulus.
The Local Planning Authority considers that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the agent satisfactory additional details have been submitted.
