| 1 | The application site is located on the main High Street in Marske in an area of mixed commercial, residential and other uses. To the immediate east of the application site (rear of the property) is Prospect Terrace an area of residential properties, access to which is by a private road from the High Street. Given the location of the application site and its relationship to the nearest adjoining residential properties the Local Planning Authority considers that the proposed change of use from Class A1 (Retail) to Class A4 (Drinking Establishment) will create conditions prejudicial to the amenity of the occupiers of those residential properties by reason of noise, general disturbance. The development proposed is considered therefore to conflict with policy CS1 (e)(Securing a Better Quality of Life) DP2 (c)(Location of Development) and DP3 (b)(c) (Sustainable Design) of the Redcar and Cleveland Local Development Framework July 2007. |
| 2 | STATEMENT OF COOPERATIVE WORKING: The application as submitted by the applicant was the subject of one amendment to retain the existing ramp but in terms of the principle of the use members of the Council's Regulatory Committee set aside the officer recommendation to grant planning permission on the grounds that the development would result in conditions prejudicial to the amenity of adjoining and nearby residential properties, since the decision was one of principle it was not possible for the Council to adopt a further negotiating position on the application. |
