# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: GR/01 Scale 1:2500, Site Layout GR/02 Scale 1:500 revised March 2016, Camping Pods Details GR/03, Timber Ship Lap Boarding Detail GR/04 and GR/05 received by the Local Planning Authority on 22 March 2016 REASON: To accord with the terms of the planning application.
3 The use of the site as a touring caravan and camping pod site hereby approved shall not be used for residential purposes other than holiday letting purposes. For the purpose of this condition holiday letting means letting to the same person, group of persons or family for period(s) not exceeding a total of 28 days in any one calendar year. REASON: The site is in a location where new residential development would be contrary to the policies within the Councils Local Development Framework.
4 Any vegetation clearance on site should avoid the bird breeding season (March to August inclusive), unless a checking survey by an appropriately qualified ecologist has confirmed that no active nests are present immediately prior to works. REASON: In the interests of the protection of breeding birds
5 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays. REASON: In the interest of neighbour amenity.
6 Any trenches, holes or similar required during construction shall be covered overnight or be provided with a means of escape for any animals that might fall in. REASON: In the interests of any protected species that use the site.
7 Prior to installation on site details of all temporary and permanent lighting shall have been submitted to the Local Planning Authority for approval in writing. The approved details shall be adhered to. REASON: In the interests of both ecology and amenity.
8 Notwithstanding the documentation submitted details of the external materials to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
9 Details of materials to be used for all hard surfaces shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of the development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
10 The use hereby permitted shall not commence until details of the arrangements for the storage of refuse have been submitted to, and approved in writing by, the Local Planning Authority. The development shall be not be carried out other than in accordance with any approval given and shall be completed prior to any part of the development hereby approved being brought into use. The use of the refuse storage area agreed shall thereafter be retained at all times. REASON: To safeguard the amenity of the area.
11 Prior to commencement of development details of a scheme for biodiversity/habitat protection and enhancements shall have been submitted to the Local Planning Authority for approval in writing. The approved scheme shall be implemented in its entirety prior to the use commencing and thereafter be maintained. REASON: In the interests of biodiversity.
12 Prior to the commencement of development a scheme for the installation of both bat and bird boxes shall be submitted to the Local Planning Authority for approval in writing. The approved scheme shall be implemented in its entirety prior to the commencement of the use and shall thereafter be maintained. REASON: In the interests of the enhancement of site for roosting bats and bird nesting
13 Prior to the commencement of construction details of drainage (foul and surface water) shall have been submitted to the Local Planning Authority and approved in writing by the Local Planning Authority. The submitted scheme shall demonstrate that the drainage at the site is no risk to flooding elsewhere. The approved scheme shall be implemented in its entirety prior to the commencement of the use of the facilities hereby approved. REASON: To ensure satisfactory drainage at this site
14 No development shall take place until a written scheme of investigation (WSI) for archaeological watching brief has been submitted to and approved in writing by the local planning authority. The WSI shall as a minimum make provision for: 1. archaeological observation (and where appropriate direction) of ground works, recording, survey and sampling of remains of archaeological significance; 2. monitoring, reporting and archiving arrangements, including reasonable notification to the Local Planning Authority of commencement and progress of works; and 3. details of staff involvement in carrying out the work, their qualifications and responsibilities. The development shall not without the prior written approval of the Local Planning Authority be carried out otherwise than in accordance with the provisions of the approved WSI. REASON: The site is of potential archaeological significance and archaeological remains disturbed by the development should be preserved by appropriate record.
15 Prior to the first occupation of the development boundary walls and fences shall have been erected in accordance with a scheme that has first been agreed in writing with the Local Planning Authority and shall thereafter be maintained. REASON: In the interests of visual and residential amenity.
16 No development on site shall commence until details of the repositioned gate access into the site together with a signage scheme that warns of the presence of the public right of way (Loftus Public Bridleway No.142).The approved details shall be implemented in their entirety prior to the commencement of any other construction activities and shall thereafter be maintained. REASON: In the interests of public safety.
17 Prior to the commencement of development details of existing and proposed ground levels together with finished floor levels for this development shall be submitted to the Local Planning Authority for approval in writing. The submitted details shall be supported with cross sections. The approved details shall be adhered to and thereafter shall be maintained. REASON: In the interests of the appearance of the development.
18 No wind turbines or solar panels shall be installed at this site except in accordance with a scheme that has first been submitted to the Local Planning Authority and approved in writing. REASON: In the interests of visual amenity.
19 In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared and submitted for the approval in writing of the Local Planning Authority. On completion of measures identified in the approved remediation scheme a verification report must be prepared and submitted for the approval in writing of the Local Planning Authority On completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
20 A landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of development. The details shall include size, type and species of plant and indicate the proposed layout and surfacing of all open areas. A programme of work shall also be submitted and implemented in accordance with the approved details. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
21 All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
22 STATEMENT OF COOPERATIVE WORKING: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
