# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: OS Plan Scale 1:1250 received by the Local Planning Authority on 29 January 2016 and Proposed Floor Plan Scale 1:100 and Site Layout Plan Scale 1:500 received by the Local Planning Authority on 14 March 2016. REASON: To accord with the terms of the planning application.
3 Notwithstanding the submitted plans prior to the commencement of the use hereby approved car and cycle parking shall have been provided in accordance with details that have first been submitted to and approved in writing by the Local Planning Authority. The parking shall thereafter be maintained. REASON: To ensure satisfactory parking provision at this site.
4 The use hereby permitted shall not commence until details of the arrangements for the storage of refuse have been submitted to, and approved in writing by, the Local Planning Authority. The development shall be not be carried out other than in accordance with any approval given and shall be completed prior to any part of the development hereby approved being brought into use. The use of the refuse storage area agreed shall thereafter be retained at all times. REASON: To safeguard the amenity of the area.
5 The premises shall only be open to customers during the following hours:- 0800 to 2200 Mondays to Fridays, 0800 to 2300 Saturdays and 0800 to 2200 Sundays and Public Holidays. REASON: To safeguard the amenities of residential properties.
6 The level of noise emitted from any permitted use of the site shall not exceed 55dBA Leq (1hr) between 7am and 11pm on any day and 45dBA Leq (15 min) at any other time, as measured on the boundary of the site at any monitoring point opposite Nos 62a to 88 High Street Lingdale and 67 High Street Lingdale. REASON: In the interests of residential amenity
7 STATEMENT OF COOPERATIVE WORKING: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
