| # | Condition Details |
|---|---|
The development shall not be begun later than the expiration of ONE YEAR from the date of this permission. REASON: The application site is located outside the approved development limits identified in the development plan and in open countryside. In such locations a policy of development restraint applies and the development applied for is acceptable as an exception to that policy by virtue of it being a conversion of an existing structurally sound building. However, the buildings are in a state of disrepair and whilst the grant of planning permission is considered appropriate at this time, based on the information provided in the application, the Local Planning Authority considers it appropriate to reduce the implementation period of the permission to one year so that, in the event of the permission not being implemented within that period, the development should be the subject of a further application so that the Planning Authority can review the condition of the site to ensure that the buildings remain capable of conversion without the need for substantial rebuilding and to review, if necessary, the impact of the works on the heritage asset.
The development hereby permitted shall be carried out in accordance with the following approved plans and documents: - Existing Site Location Plan, Drawing No. MH939-01, Rev D, - Proposed Site Plan, Drawing No. MH939-07, Rev E, - Proposed Ground Floor Plan, Drawing No. MH939-08, Rev B, - Proposed First Floor plan, Drawing No. MH939-09, Rev B, - Proposed Elevations, Sheet 1 of 2, Drawing No. MH939-10, Rev C, - Proposed Elevations, Sheet 2 of 2, Drawing No. MH939-11, Rev C, - Proposed Passing Place Provision, Drawing No. CBO-0357-001 Rev A, all received by the Local Planning Authority on 15 January 2016, and, - Proposed Foul and Surface Waterlayout Details, Drawing No. 016/060/01 received by the Local Planning Authority on 31 March 2016. REASON: To accord with the terms of the planning application.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 2015, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: In order that the Local Planning Authority can exercise appropriate control over further additions to the properties as a heritage asset.
Notwithstanding the provisions of the Town and Country Planning General Development Order, 1995 (or any Order revoking or re-enacting that Order), no detached buildings shall be erected within the curtilage of the dwelling(s) the subject of this permission, without the express consent of the Local Planning Authority. REASON: In order that the Local Planning Authority can exercise appropriate control over further additions to the properties as a heritage asset.
Details of the external materials to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure that the materials to be used in the development are appropriate to the character of the heritage asset.
Parking to serve the development and passing places as shown on the approved plan 'Proposed Passing Place Provision, Drawing No. CBO-0357-001 Rev A,' shall be constructed and be available for use, prior to any of the dwellings being occupied and thereafter shall be retained and maintained as such. REASON: In the interests of highways safety.
Unless otherwise agreed by the Local Planning Authority in writing, development other than that required to be carried out as part of an approved scheme of remediation must not commence until parts (a) to (c) have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until condition (e) has been complied with in relation to that contamination. (a) Site Characterisation An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include: (i) a survey of the extent, scale and nature of contamination; (ii) an assessment of the potential risks to: • human health, • property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, • adjoining land, • groundwaters and surface waters, • ecological systems, • archeological sites and ancient monuments; (iii) an appraisal of remedial options, and proposal of the preferred option(s). This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’. (b) Submission of Remediation Scheme A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. (c) Implementation of Approved Remediation Scheme The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report (referred to in PPS23 as a validation report) that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority. (d) Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirements of part (a) and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of part (b), which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. (e) Long Term Monitoring and Maintenance A monitoring and maintenance scheme to include monitoring the long-term effectiveness of the proposed remediation over a period of 10 years, and the provision of reports on the same must be prepared, both of which are subject to the approval in writing of the Local Planning Authority. Following completion of the measures identified in that scheme and when the remediation objectives have been achieved, reports that demonstrate the effectiveness of the monitoring and maintenance carried out must be produced, and submitted to the Local Planning Authority. This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’ REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
Prior to the commencement of the development, or in such extended time as may be agreed in writing with the Local Planning Authority, details shall be submitted and approved of the septic tank and surface water soakaway and the development shall be completed in accordance with the approved scheme. The design of the drainage scheme shall include; (i) Percolation test results to confirm the septic tank and soakaway designs. (ii) Septic tank and soakaway details REASON - To ensure the development is supported by a suitably designed surface water disposal infrastructure scheme and to minimise the risk flooding in the locality.
No dwelling shall be occupied until a Management & Maintenance Plan for the surface water drainage scheme has been submitted to and approved by the Local planning Authority; the plan shall include details of the following; (i) Arrangements for the maintenance of the SUDS elements of the surface water system REASON - To ensure that the surface water drainage infrastructure is maintained to minimise the risk flooding in the locality.
The Local Planning Authority considers that the application as originally submitted did not have sufficient information to enable the Local Planning Authority to determine the application; following the receipt of this information, it is considered that a satisfactory scheme has been negotiated.
