The development hereby permitted shall be carried out in accordance with the following approved plans and documentation: 1502 - 1 - ELT - BATCH DIST - 001 - RO, 1502 - 2 ELT EVAPORATION & VACUUM -001 - RO and 1502 - 2 - ELT - HYDRO - 001 - RO received by the Local Planning Authority on 4 November 2015 Letter from CSG dated 29 September 2016 received by the Local Planning Authority on 30 September 2016, refinery site layout received by the Local Planning Authority on 8 January 2016, DWG003, DWG004,DWG005 and DWG006 received by the Local Planning Authority on 4 January 2016 REASON: To accord with the terms of the planning application.
Development shall not commence until a detailed scheme for the disposal of foul and surface water from the development hereby approved has been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall take place in accordance with the approved details. REASON: To prevent the increased risk of flooding from any sources in accordance with the NPPF.
Unless otherwise agreed by the Local Planning Authority in writing, development other than that required to be carried out as part of an approved scheme of remediation must not commence until parts (a) to (c) have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until condition (e) has been complied with in relation to that contamination. (a) Site Characterisation An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include: (i) a survey of the extent, scale and nature of contamination; (ii) an assessment of the potential risks to: • human health, • property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, • adjoining land, • groundwaters and surface waters, • ecological systems, • archeological sites and ancient monuments; (iii) an appraisal of remedial options, and proposal of the preferred option(s). This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’. (b) Submission of Remediation Scheme A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. (c) Implementation of Approved Remediation Scheme The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority. (d) Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirements of part (a) and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of part (b), which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. (e) Long Term Monitoring and Maintenance A monitoring and maintenance scheme to include monitoring the long-term effectiveness of the proposed remediation over a period of 10 years, and the provision of reports on the same must be prepared, both of which are subject to the approval in writing of the Local Planning Authority. Following completion of the measures identified in that scheme and when the remediation objectives have been achieved, reports that demonstrate the effectiveness of the monitoring and maintenance carried out must be produced, and submitted to the Local Planning Authority. This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’ REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
Prior to the first occupation of the development boundary walls and fences shall have been erected in accordance with a scheme that has first been agreed in writing with the Local Planning Authority and shall thereafter be maintained. REASON: In the interests of visual and residential amenity.
Any work to the currently undeveloped areas of grassland shall take place outside of the bird nesting season (March-August inclusive). Alternatively those areas should be checked by a suitably qualified ecologist within 48 hours of any clearance works commencing, with works commencing only if an ecologist confirms in writing that no nesting birds were found to be present. REASON: In the interests of the protection of protected species.
The external materials to be used in the development shall be as specified on the application form Section 9 received by the Local Planning Authority on 30 September 2016. REASON: To ensure the use of satisfactory materials.
Statement of Co-operative Working: The Local Planning Authority considers that the application as originally required additional supporting information and revisions. Following correspondence with the applicant a satisfactory scheme has been negotiated.
Informative Note: The proposal to undertake recovery of oils and other hydrocarbons may require a variation to the existing CSG Environmental Permit EPR/MP3136HW. This is also the case if the activities are to extend beyond the existing permit boundary. Early discussions with the Environment Agency officer regulating the site, is recommended.
Informative Note: The Environment Agency has advised: The applicant should also be aware the western edge of the proposal area intersects the boundary of an existing permitted landfill site termed the ICI Perimeter Mounds (EAWML 60094; CLE/66). This is an inert industrial waste site operated by ICI Chemicals & Polymers (now Azko-nobel) and is currently in aftercare. There are known to be three environmental monitoring boreholes associated with this site in this area, and although it is not expected that landfill gas will be an issue with this development, the developer should be aware of the potential presence of landfill gas. Any development on this landfill area will need to be with the agreement of the landfill permit holder as this may affect the eventual surrender process for the landfill site.
Informative Note: NWL advises a 900mm raw water main crosses the site and may be affected by the proposed development. Northumbrian Water do not permit a building over or close to our apparatus. The developer should contact NWL at the earliest opportunity to discuss protection measures of the water main.
