# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 The development hereby permitted shall be carried out in accordance with the following approved plans: - Site Plan as proposed, Drawing Number: MOL 1412S 1998, - Plan View Sludge & Oil Treatment, Drawing Number MOL 1412S 1999, - Elevation A Sludge & Oil Plant, Drawing Number MOL 1412S 2000, - Elevation B Sludge & Oil Plant, Drawing Number MOL 1412S 2001, - Elevation C Sludge & Oil PLant Excluding Road Tanker, Drawing Number MOL 1412S 2002, received by the Local Planning Authority on 06.02.15. REASON: To accord with the terms of the planning application.
3 The vertical storage tanks hereby approved shall be painted grey as specified in the planning application hereby approved. REASON: To ensure that the appearance of the development is acceptable in this industrial area, in the interests of the visual amenity.
4 Statement of Co-operative Working: The Local Planning Authority considers that the application as originally submitted is a satisfactory scheme and therefore no negotiations have been necessary.
5 Informative Note: The application site is on land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site. Construction workers during development and future site workers should be aware that the presence of contamination may exist and suitable health and safety and PPE should be used at all times.
6 Informative Note: The proposal states there are existing foul and surface water connections to a Northumbria Water Limited (NWL) sewer, so there should be no discharge to the environment. NWL sewer plan appears to show both the separate foul and surface sewers going to a combined sewer, rather than the surface water going to watercourse. NWL may need to be informed if there will be an increase in volume discharged into their network. The applicant is advised to contact the Environment Management team at Darlington Office on 01325 376179 or refer to guidance on their website http://www.environmentagency.gov.uk/subjects/waste.
7 Informative Note: Any additional surface water discharges from this site should be flow regulated so as not to exacerbate flooding problems elsewhere in the catchment. It is recommended consultation is carried out with Northumbria Water Ltd. and the Environment Agency prior to the hereby approved proposal being commenced.
8 Informative Note: The Environmental Protection (Duty of Care) Regulations 1991 for dealing with waste materials are applicable for any off-site movements of wastes. The developer as waste producer therefore has a duty of care to ensure all materials removed go to an appropriate permitted facility and all relevant documentation is completed and kept in line with regulations. If any controlled waste is to be removed off site, then the site operator must ensure a registered waste carrier is used to convey the waste material off site to a suitably permitted facility. The applicant is advised to contact the Environment Management team at Darlington Office on 01325 376179 or refer to guidance on their website http://www.environmentagency.gov.uk/subjects/waste.
9 Informative Note: The proposed development is approximately 185m from residential properties (St James Court). The facility is already subject to an Environmental Permit for Waste Treatment regulated by the Environment Agency and will probably require a permit variation to accommodate the extra treatment plant and processing equipment. There is the potential to create odour from the proposed operation and therefore it is recommended that an odour management plan be included in the varied permit to ensure odours from the treatment plant are subject to Best Available Techniques and minimised beyond the process boundary.
