The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
This permission shall expire 25 years from the date when electrical power is first exported from any of the wind turbines hereby permitted to the electricity grid network, excluding electricity exported during initial testing and commissioning (“First Export Date”). Written confirmation of the First Export Date shall be provided to the local planning authority no later than one calendar month after the event.
The development hereby permitted shall be carried out in accordance with the following approved plans: Drawing 001 Site Location received by the Local Planning Authority on 24 July 2013; Drawing 002 Block Plan received by the Local Planning Authority on 24 July 2013; Drawing 003 Typical Turbine Elevations received by the Local Planning Authority on 24 July 2013; Drawing 004 Other Site Infrastructure received by the Local Planning Authority on 24 July 2013; REASON: To accord with the terms of the planning application.
The noise emitted from the wind turbine , as measured in accordance with the guidelines stated within ETSU-R-97, at the curtilage boundary of any dwelling (as in existence at the time of this permission) shall not exceed 35dB(A)L90, 10 min at wind speeds of up to 10m/s at 10m height. The measurements shall be made in accordance with methodology detailed in `ETSU-R-97: the Assessment and Rating of Noise from Wind Farms` and the noise emission values for the wind turbines shall include the addition for any tonal penalty as recommended in the same document. REASON: The condition is required to ensure that the development does not exceed the noise emission limits set out in ETSU-R-97: The Assessment and Rating of Noise from Wind Farms, to protected the nearest sensitive receptors from noise impacts.
Prior to the commencement of the development hereby permitted details of the selected wind turbine (if different from the candidate wind turbine - Turbowinds T400 - 34) to be installed shall be submitted to and approved in writing by the Local Planning Authority. Details of such equipment shall include the noise certification credentials, mode of operation, technical controls and location and distance from the nearest dwelling shown on a scale plan. REASON: The condition is required to ensure that the development does not exceed the noise emission limits set out in ETSU-R-97: The Assessment and Rating of Noise from Wind Farms, to protected the nearest sensitive receptors from noise impacts.
Within 21 days from receipt of a written request from the Local Planning Authority following a written and specified complaint to it alleging noise disturbance at a dwelling, the wind turbine operator shall at its expense, employ an independent consult approved by the Council to assess the level of noise emissions from the wind turbine at the complainants' property in accordance with procedures described in `The Assessment and Rating of Noise from Wind Farms, ETSU-R-97 published by ETSU for the Department of Trade and Industry and submit a report on the consultant's findings to the Local Planning Authority. If noise levels are found to exceed those stated in Condition 4 appropriate mitigation measures shall be included within the report and the measures as approved shall be implemented in accordance with a timescale also approved by the Local Planning Authority. Where wind speed is measured at a height other than 10m, the wind speed date shall be converted to 10m height and details of the conversion method used shall be provided to the Local Planning Authority. REASON: The condition is required to ensure that the development does not exceed the noise emission limits set out in ETSU-R-97: The Assessment and Rating of Noise from Wind Farms, to protect the nearest sensitive receptors from noise impacts.
Prior to the commencement of development full details of the access to the site for abnormal loads (turbine blades and tower delivery, etc) and shall include any temporary works, swept path analysis for all vehicles manoeuvres and the sequencing of the project including a detailed programme for each activity, type and number of vehicles and reinstatement of any features lost as a result of the access arrangements shall be submitted to the Local Planning Authority for approval in writing. REASON: The site is within a rural area and where Wilton Lane has a 7.5 tonne limit as it is unsuitable for continuous HGV. It is appropriate therefore, to ensure that the movement of abnormal loads takes place based on a pre-planned programme to ensure that the impact of such traffic movements have the minimum impact on the local highway network.
No development shall take place until the applicant has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted to and approved in writing by the local planning authority. The development shall them be carried out in accordance with the approved programme. REASON: To ensure that provision is made for the appropriate assessment of the archaeological resource in the course of the development.
The developer/operator shall install MoD-accredited 25 candela omni-directional aviation lighting or infrared navigation warning light with an optimised flash pattern of 60 flashes per minute of 200ms to 500ms duration at the highest practicable point on the turbine. The turbine will be erected with this lighting installed and the lighting will remain operational throughout the lifetime of the development. REASON: In the interests of Aviation Safety and to accord with the consultation response of the MoD.
No development shall commence unless and until an Air Traffic Control Radar Mitigation Scheme to address the impact of the wind turbine upon air safety has been submitted to and approved in writing by the Local Planning Authority. The Air Traffic Control Radar Mitigation Scheme is a scheme designed to mitigate the impact of the development upon the operation of the Primary Surveillance Radar at RAF Leeming (“the Radar”) and the air traffic control operations of the Ministry of Defence (MOD) which is reliant upon the Radar. The Air Traffic Control Radar Mitigation Scheme shall set out the appropriate measures to be implemented to mitigate the impact of the development on the Radar and shall be in place for the operational life of the development provided the Radar remains in operation. The turbine shall not become operational unless and until all those measures required by the approved Air Traffic Control Radar Mitigation Scheme to be implemented prior to the operation of the turbine have been implemented and the Local Planning Authority has confirmed this in writing. The development shall thereafter be operated fully in accordance with the approved Air Traffic Control Radar Mitigation Scheme. REASON: In the interests of aviation safety and to accord with the consultation response of the Ministry of Defence.
No later than twelve months before the expiry of this permission a scheme for the de-commissioning of the turbine and the restoration of the site shall be submitted to the Local Planning Authority for approval in writing. The scheme shall make provision for the removal of the wind turbine and its associated ancillary equipment to a depth up to one metre below ground and the re-instatement of the site. The scheme shall include proposals for the management and timing of the works, measures to be taken to safeguard and, where possible, enhance wildlife habitats, a traffic management plan and shall be implemented as approved. REASON; To ensure that at the expiry of the terms of the planning permission the turbine is removed in accordance with an agreed scheme of de-commissioning to minimise the long term impact of the development on the local landscape.
If the wind turbine fails for a continuous period of 12 months to supply electricity to the local electricity grid network, then, unless otherwise approved in writing by the local planning authority that wind turbine and ancillary development solely related to it shall be taken down and removed from the site and the land shall be re-instated in accordance with a re-instatement scheme approved in writing by the local planning authority (which shall include a timetable for the removal of the turbine(s) and the reinstatement of the land). The developer shall submit the re-instatement scheme to the local planning authority not later than 28 days after the expiry of the twelve month period provided for in this condition, and the scheme shall be implemented as approved. REASON; To ensure that in the event of the turbine becoming non- operational it is removed in accordance with an agreed scheme of de-commissioning to minimise the long term impact of the development on the local landscape.
No development shall commence until a Construction Method Statement has been submitted to and approved in writing by the local planning authority. The construction of the development shall only be carried out in accordance with the approved Construction Method Statement, unless otherwise approved in writing by the local planning authority.
