1 The application proposes extending the opening hours of the premises until 2300 hours Monday to Sunday. The application site, whilst being located in an area which provides a range of local services, adjoins property which is used for residential accommodation. It is considered the use of the premises until 2300 hours would give rise to conditions prejudicial to the amenity of those adjoining residential properties by reason of noise and general disturbance. The development is considered contrary to policy DP2 (Location of Development) DP3 (Sustainable Design) and DP6 (Pollution Control) of the Redcar and Cleveland Local Development Framework - Development Polices DPD July 2007.
