| # | Condition Details |
|---|---|
| 1 | The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | The development hereby permitted shall be carried out in accordance with the following approved plans: Dwg No P104 Rev P1 and P114 Rev P1 received by the Local Planning Authority on 26/07/12 REASON: To accord with the terms of the planning application. |
| 3 | Prior to the commencement of development hereby approved a Construction Traffic Management Plan shall be submitted to and agreed in writing with the Local Planning Authority. The management plan subsequently approved shall then be implemented in accordance with the details agreed until the substantial completion of the development. . REASON: In order that the movement of construction traffic is appropriately managed in the interest of highway safety. |
| 4 | All digestate to be processed in the plant hereby approved shall be sourced from Howla Hay Farm only and shall not be imported from external sources. REASON: Whilst the Local Planning Authority is satisfied the construction traffic associated with the development can be safely managed through condition (3) above, it remains concerned that highways access to the site is not of a sufficient standard to accommodate significant additional vehicle movements that would be associated with the importation of waste to the site. A planning condition that restricts the source of the waste to that produced on the application site is considered appropriate in the interests of highways safety. |
| 5 | REASON FOR DECISION: The application proposes the development of an anaerobic digestion plant. The site is located outside the limits to development identified in the development plan but the proposal is one, which it is accepted, is appropriate to a countryside location for technical reasons and as diversification of the rural economy. The development is co-located with existing buildings on the farm unit would not result in an unacceptable proliferation of buildings in the open countryside. The general design and layout of the development is acceptable and would not unacceptably adversely affect the appearance of the locality. The development does raise concerns in respect of highways matters but these are appropriately dealt with by planning conditions and it is concluded therefore the proposal accords with the Council's adopted Development Plan and Supplementary Planning Guidance. |
