# Condition Details
Details of the appearance, landscaping, and scale, (hereinafter called "the reserved matters") shall be submitted to and approved in writing by the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters and to comply with the requirements of Section 91 and 92 of the Planning Act (as amended)
The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last of the reserved matters to be approved, whichever is later. REASON: Required to be imposed pursuant to Section 92 of the Planning & Compulsory Purchase Act 2004.
The chalet buildings hereby approved shall be used only as temporary accommodation for holiday lets or the provision of temporary periods of respite care. The buildings shall at no time be used as permanent family dwellings for a use within Class C3 of the Town and Country Planning (Use Classes) Order 1987 (as amended). REASON: The site is located in open countryside, outside the approved development limits identified in the Development Plan where a policy of development restraint applies. In such locations, the provision of new housing requires special justification. The development is approved as an exception to this policy only on the basis that it provides accommodation which will be occupied on a temporary basis for tourism or respite care in accordance with the exceptions identified in the Development Plan. In addition, the quality of the buildings is such there they are only suitable as temporary accommodation for limited periods. A condition restricting the use of the use of the site is required in order that Development Plan policy is not prejudiced in respect of the provision of new permanent housing in the countryside.
The Landscaping details proposed to be submitted for approval as a Reserved Matter under condition (1) above shall include details of a new bund and boundary treatment to the northern boundary of the site. The approved details shall be implemented in full prior to the first occupation of any of the chalets, or in such extended time as may be agree in writing with the Local planning Authority. The details shall include sections of the bund to illustrate the existing and proposed profile of the land on the northern boundary and associated boundary planting. REASON: The northern boundary of the site is presently exposed and sits at a higher level that the surrounding land to the north, the bunding and landscaping / boundary treatment is required to minimise the impact of the development on the landscape and to promote the development of a boundary treatment that appropriately screens the development in accordance with Development Plan policy.
Prior to the first occupation of the development boundary walls and fences shall have been erected in accordance with a scheme that has first been agreed in writing with the Local Planning Authority and shall thereafter be maintained. REASON: In the interests of visual and residential amenity.
Prior to the commencement of the development hereby approved details shall be submitted and approved of measures to protect the existing trees on or adjacent to the site from the effects of construction, the details shall meet the general requirements of BS5837 and the approved measures shall be installed on site before the start of development (including any site clearance or demolition) and the measures shall remain on site during the construction phase of the development. REASON; To protect the existing trees on and in the vicinity of the site from the effects of construction in the interests of visual amenity.
All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays. REASON: In the interest of neighbour amenity.
The development hereby permitted shall be carried out in accordance with the following approved plans: D10070-10 Rev. D and D10070-01 Rev.C received by the Local Planning Authority on 13th Novemebr 2012 REASON: To accord with the terms of the planning application.
In determining the application the Planning Committee concluded that, although outside the approved development limits, the development was one that was related to the provision of tourism and respite care and was an appropriate development which met the policy exception set out in the Development Plan. They noted the concerns of officers in respect of the impact of the development on the landscape but concluded that subject to an appropriate landscaping and treatment to the northern boundary of the site, the development would comply with the relevant policies in the Development Plan. They note that there were no objections in respect of highways matters and that the application now made provision for the use of the existing access from the adjoining highway. The development would replace a derelict barn on the site which would lead to a general improvement in the visual quality of the local environment.
The Local Planning Authority consider that the application as originally submitted did not meet with the local policies and guidance. Following discussions with the applicant / agent a satisfactory scheme has been negotiated. .
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS6, CS12, CS20, CS22, CS24, DP1, DP2, DP3, DP5, and DP16.
