# Condition Details
1 The application site is a commercial premises currently in use as a restaurant within Class A3 of the Town and Country Planning (Use Classes) Order 1987. The application proposes a variation of planning condition (4) of planning permission R/2007/0974/CA granted on 2.11.2007 which required the external flue to be enclosed in brickwork, to permit the painting of the external rear emissions flue. The existing flue is located on the rear of the premises on the north facing elevation of the building, it is constructed in stainless steel and is considered to be an obtrusive structure detrimental to the appearance and character of the Conservation Area within which the application site is located. In refusing the application the Local Planning Authority takes the view that the painting of the flue will not materially alter the external appearance of the structure which will remain an obtrusive feature when viewed in the surrounding area detrimental to the appearance and character of the Conservation Area and contrary to policy CS25 (Built and Historic Environment) DP3 (Sustainable Design) and DP9 (Conservation Areas) of the adopted Redcar and Cleveland Local Development Framework.
