# Condition Details
1 The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to section 18 of the Planning (Listed Buildings and Conservation Areas) Act 1990.
2 The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays. REASON: In the interest of neighbour amenity.
3 This consent shall not be executed before a contract for the carrying out of works of redevelopment of the site has been made or that should there be no intention for a scheme of redevelopment the land should be suitably landscaped, grassed and seeded. REASON: To safeguard the character and appearance of the Loftus Conservation Area.
4 If no redevelopment is to occur as per Condition 3 a landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of development. The details shall include size, type and species of plant and indicate the proposed layout and surfacing of all open areas. A programme of work should also be submitted and implemented in accordance with the approved details. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
5 Before any on site work in connection with demolition are started a joint condition survey with the applicant, their contractor and the Highway Authority is to be undertaken of the adopted highway and its associate footways. REASON To ensure the protection of the adopted highway.
6 REASON FOR DECISION: The proposed development will preserve the character and appearance of the Conservation Area. The proposal complies with Policies CS25 and DP9 of the Council’s adopted Development Plan and Supplementary Planning Guidance.
7 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, CS25, DP2, DP3, DP9 and Loftus Conservation Area Appraisal.
8 Informative Note: At no point should the adopted highway be blocked up with out the prior consent of the Councils Highways Maintenance section.
9 Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
10 Informative Note: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
11 Informative Note: Notwithstanding any approved details made under planning provisions, should any noise, odour or other nuisance occur then action may be taken under statutory nuisance provisions.
