| 1 | The open space contributes to the setting of the buildings on Albion Terrace and the loss would have significant harm on the character and apperance of this area. The proposal is therefore contrary to the aims of policy DP9 and DP13 of the Local Development Framework (2007) which refers to both public and private spaces. As the development would have significant adverse impact on heritage assets and there would be an unacceptable loss of the important open space the proposal would be contrary to policy DP2 of the Local Development Framework (2007). |
| 2 | The loss of the open space and the building of dwellings on the site would impact on the setting of the existing properties on Albion Terrace and the character and apperance of this area. The view of the Local Planning Authority is that the application does not respect or enhance the character and apperance of the local area. The proposal is considered to be detrimental to the character of this area within the Conservation Area and the proposal is contrary to policies CS20 and DP9 of the Local Development Framework (2007) and the information contained within the Guisborough Conservation Area Appraisal. |
| 3 | NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS2, CS7, CS13, CS15, CS17, CS20, CS22, CS25, DP1, DP2, DP3, DP6, DP7, DP9, DP11 and DP13; Design of Residential Areas Supplementary Planning Document; Guisborough Conservation Area Appraisal. |
| 4 | The development hereby permitted shall begin not later than three years from the date of this decision. |
| 5 | Other than as required by the conditions below, the development hereby permitted shall be carried out in accordance with the following approved plans: Drawing Nos. 10/280/01, 10/280/03, 10/280/04 & 10/280/08. |
| 6 | No development shall take place until a written scheme of investigation (WSI) for an archaeological watching brief has been submitted to and approved in writing by the local planning authority. The WSI shall include:- • Provision for archaeological monitoring of all works at a depth of more than 300mm below current ground level; • Provision for the observation, recording, interpretation, and dissemination of information by report of all deposits, artefacts or other remains of archaeological interest encountered during the works; • A programme of works and monitoring arrangements, including reasonable notification to the local planning authority of commencement of works; and • Details of staff involvement in carrying out the watching brief, and their qualifications and responsibilities. The development shall be carried out in accordance with the approved WSI. |
| 7 | No development including site clearance shall commence until trees shown to be retained in this permission have been protected by fencing or other agreed barriers. Any fencing shall conform to the specification as shown in BS 5837:2012 Trees in relation to design, demolition and construction and shall be submitted to and approved in writing by the local planning authority. Such fencing or barrier shall be maintained during the course of the works on site. |
| 8 | Notwithstanding any details of materials set out in the application, no development shall take place until samples of materials to be used in the construction of the external surfaces of the dwellings and all hard surfaces, including the driveway and pathways hereby permitted, have been submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the approved samples. |
| 9 | Prior to the commencement of development, details of contractors’ car parking and material storage within the site, shall be submitted to and agreed in writing by the local planning authority. The details approved shall be retained for use until the completion of the development. |
| 10 | No demolition, construction works or delivery of materials shall take place outside 08:00 hours to 18:00 hours Mondays to Fridays and 08:00 hours to 13:00 hours on Saturdays, and not at any time on Sundays or Bank Holidays. |
| 11 | Prior to the first occupation of the development, the proposed boundary walls and fences shall have been erected in accordance with a scheme to have been first agreed in writing with the local planning authority. The boundary walls and fences shall be maintained thereafter. |
| 12 | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no enlargement of the dwelling house, as permitted by Class A, B, C or E of Part 1 of the Second Schedule of the Order, shall be constructed. |
| 13 | Full details of the means of disposal of foul and surface water shall be submitted to the local planning authority for approval prior to the development being commenced. The approved works shall be implemented prior to the completion of development and shall be maintained operational at all times thereafter. |
