|---|---|
The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
The variation of condition hereby approved shall not be implemented until the highway works (reconfigured internal road layout, new exit road and new parking layout) as shown on drawing 6720 P-01 received by the Local Planning Authority on 22.09.2011, have been implemented in their entirety. REASON: To ensure that the highways works are implemented prior to development on the site and accommodate predicted traffic growth.
Unit B shall be used for the sale of food (Class A1) and non-food (Class A1) goods, with the exception of the following goods which shall not be sold; • Clothing and shoes, fashion accessories including handbags, luggage, watches and jewellery. • Pharmaceutical and personal care products, including perfumes, toiletries, spectacles and contact lenses. • Toys, books, music records, and CDs, DVDs, videos and audio tapes. • China, fancy goods and giftware. unless any of the above are ancillary to the main use of the unit. REASON: To restrict the sale of goods from the site in order to protect the existing commercial centres.
The application raises no issues in terms of neighbour amenity, crime prevention or highways safety. It is considered that the application has satisfactorily undertaken the sequential assessment and impact assessment as required under PPS4 and LDF Policy CS18. The application site is located within the urban area and is accessible by public transport; and would have a positive impact on local employment; all of which would represent positive impacts in respect of Policy EC10 of PPS4. Furthermore, the proposals would also accord with the draft National Planning Policy Framework and ministerial statement ‘Planning for Growth’. The development would support the economic recovery of the area.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy - CS1, CS2, CS3, CS9, CS18, CS20, CS26, DP1, DP2, DP3. Local Plan Policy - SH12.
