# Condition Details
1 (1) The development shall be begun not later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) The development hereby permitted shall be carried out in accordance with the following approved plans: 1393/005B received by the Local Planning Authority on 26.08.2011 1393/002 Rev C received by the Local Planning Authority on 26.08.2011 1393/001 Rev A received by the Local Planning Authority on 26.08.2011 REASON: For the avoidance of doubt.
3 (3) The premises shall not be open to customers outside the following hours 08.00 – 23.00 (Monday to Sunday) REASON: To safeguard the amenities of residential properties
4 (4) Prior to the use hereby approved being brought into use a scheme for the effective control of fumes and odours from the premises shall be submitted to and agreed in writing by the Local Planning Authority. The scheme approved shall be implemented prior to the use commencing and thereafter retained at all times. REASON: In the interest of residential amenities of the area.
5 REASON FOR DECISION: It is considered that the proposed development will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the Conservation Area. The use is considered acceptable given the location in a designated centre, the development will not adversely affect the vitality and viability of the centre. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council's adopted Development Plan and Supplementary Planning Guidance.
6 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, DP2, DP3, CS18, CS25, DP9 and Marske Conservation Area Appraisal.
